The CHRC special report on repeal of section 67 “[promoted] the resolution of a long-standing and unacceptable gap in human rights protection”(29) for First Nations people, suggesting that, in light of strong objections to and calls for repeal of the provision since 1977, “[it] can be assumed that, but for the existence of section 67, many complaints would have been filed with the Commission” (30) The report noted the exemption’s inconsistency with Canada’s domestic and international human rights obligations; (31) reviewed legal and constitutional developments in relation to Aboriginal rights since 1977; and acknowledged the perceived conflict between collective Aboriginal rights and individual rights (32)
