2. Further deplores the fact that the existing regulations – in combination with incomplete implementation measures at national and regional level, the plethora of soft law proposals put forward by the Commission, and the interpretation of the relevant legal provisions by European and national courts – have given rise to a complicated and confusing set of rules which is creating, in particular for public bodies, private undertakings and providers of services of general interest, serious legal problems that can no longer be overcome without incurring substantial administrative costs or seeking external legal advice; urges the Commission to remedy this situation and, as part of the ‘Better Lawmaking’ initiative, to examine the impact of soft law proposals, to restrict such proposals to key aspects and to assess them in the light of the principles of subsidiarity and proportionality, taking into account the five principles set out in the 2001 White Paper on European Governance (openness, participation, accountability, effectiveness and coherence);
2. déplore en outre que la conjonction des droits communautaires, nationaux et régionaux, résultant notamment de la transposition incomplète en droit national des directives européennes sur les marchés publics et d'une multiplicité d'initiatives de droit indicatif prises par la Commission, ainsi que de l'interprétation par les tribunaux européens et nationaux aient débouché sur un régime juridique complexe et opaque, confronte les organismes publics, les entreprises privées et les prestataires de services d'intérêt général à de graves problèmes juridiques, qu'ils ne peuvent plus gérer sans consentir des efforts supplémentaires ou faire appel à des consultants juridiques extérieurs; demande instamment à la Commission de remédier à cette situation et d'étudier, dans le contexte de l'initiative «mieux légiférer» les répercussions du droit indicatif, de limiter ces propositions aux aspects essentiels et de les évaluer au regard de la subsidiarité et de la proportionnalité et eu égard aux cinq principes énoncés par le livre blanc de 2001 sur la gouvernance européenne (ouverture, participation, responsabilité, efficacité et cohérence);
