Where, before an authorisation is issued by the national safety authority, the Agency becomes aware or is informed by the applicant through the one-stop shop in accordance with Article 19(6) of Directive (EU) 2016/797 that a project design or specification was changed after the Agency had issued an approval in accordance with Article 19 of Directive (EU) 2016/797 and that there is a risk of a lack of technical and operational compatibility between the ERTMS trackside subsystem and vehicles fitted with ERTMS, it shall cooperate with the parties involved, including the applicant and the relevant national safety authority, in order to find a mutually acceptable solution.

7. The contracting authority shall accept any other appropriate means of proof than those referred to in paragraph 6, such as a technical dossier from the manufacturer, where the economic operator had no access to the certificates or test reports, or no possibility of obtaining them or obtaining a specific label within the relevant time limits, for reasons that are not attributable to that economic operator and provided that the economic operator concerned proves that the works, supplies or services to be provided fulfil the requirements of the specific label or specific requirements indicated by the contracting authority.

At the close of its discussions the Council adopted the following conclusions: "THE COUNCIL - REITERATES that in its Resolution of 7 February 1994 it invited the Commission to propose, before 1 July 1994, the measures necessary for the realization of the objectives identified, with a view to implementing without delay a Community policy on postal services, and in particular measures relating to universal service, services which can be reserved, and standardization; - NOTES that on 26 July 1995 the Commission accordingly adopted an overall approach consisting of the abovementioned draft Notice and a proposal for a Directive based on Article 100a, providing for a harmonized framework for the postal sector; - EMPHASIZES that the relevant Council bodies began the technical discussions without delay and that today the Council had an initial policy debate on the proposal for a Directive and a debate on the draft Notice; - AGREES to continue active discussion of the proposal for a Directive in order to arrive at an agreed common position under the auspices of the Italian Presidency; - OBSERVES that the Notice envisaged by the Commission is not in itself binding but is a document in which it announces the guidelines it intends to follow in applying the Treaty's competition rules to the postal sector; - REQUESTS the Commission, in any follow-up to its draft Notice, to take the utmost account of the Council's comments, especially on the need to ensure, for the sake of transparency and legal certainty, that: - the definitions and concepts used in the Notice, in the proposal for a Directive or in other relevant Community provisions are consistent with one another; - the notice is published in the Official Journal at the same time as the Directive and in any case before the end of 1996; - EMPHASIZES that these conclusions are without prejudice to the positions of the Member States on the form and content of the Commission Notice".
