While it is indeed true, as the French Republic has maintained, that, at the very least as from 24 June 2008, the Council could not possibly allow a situation to continue in which Decision 2007/868 lacked any basis, but had as soon as possible to take appropriate action, the fact nevertheless remains, as indeed that Member State accepts and as the General Court rightly pointed out at paragraph 42 of the judgment under appeal, that neither the judgment of the Court of Appeal nor the Home Secretary’s order of 23 June 2008 had an automatic, immediate effect on Decision 2007/868, then applicable.
