Under Article 4 of Council Regulation (EEC) No 1883/78 of 2 August 1978 laying down general rules for the financing of interventions by the European Agricultural Guidance and Guarantee Fund, Guarantee Section , the amount to be financed by an intervention measure is to be determined on the basis of the annual accounts drawn up by the paying agencies.
L'article 4 du règlement (CEE) no 1883/78 du Conseil du 2 août 1978 relatif aux règles générales sur le financement des interventions par le Fonds européen d'orientation et de garantie agricole, section «garantie» a prévu que le montant à financer au titre d’une mesure d’intervention est déterminé par des comptes annuels établis par les organismes payeurs.

Member States shall pay to the EAGGF, Guarantee Section, the levy corresponding to the overrun of their national reference amount, reduced by a flat-rate amount of 1 % in order to take account of cases of bankruptcy or the definitive inability of certain producers to make their contribution to the payment of the levy due.
Il convient que les États membres versent au FEOGA, section «Garantie» le prélèvement correspondant au dépassement de leur quantité de référence nationale, réduit d'un montant forfaitaire de 1 % afin de tenir compte des cas de faillite ou d'incapacité définitive par certains producteurs de payer leur contribution au paiement du prélèvement dû.

(19) Since the amounts which will become available as a result of cross compliance are not foreseeable sufficiently far ahead to be used for additional measures in the framework of rural development support, those amounts should be credited to the EAGGF "Guarantee" Section, except for a certain percentage which should be retained by the Member States.
(19) Étant donné que les montants résultant de la conditionnalité ne peuvent être prévus suffisamment à l'avance pour pouvoir être affectés à des mesures supplémentaires relevant du soutien au développement rural, il conviendrait de porter ces montants au crédit du FEOGA, section "Garantie", à l'exception d'un certain pourcentage conservé par l'État membre.

2. The amounts resulting from application of the reductions provided for in paragraph 1, after deducting the total amounts referred to in Annex II, shall be available as additional Community support for measures under rural development programming financed under the EAGGF "Guarantee" Section according to Regulation (EC) No 1257/1999.
