The sixth ground of appeal concerns errors of law relating to the assessments of the General Court with regard to Austria.

It is for the Member State to put forward any grounds of compatibility (80) and to demonstrate that the conditions thereof are met, and for this reason alone Austria is prevented from relying on this ground of compatibility.

Austria disputes these findings, on the following grounds.

– (DE) Mr President, I would like to point out that I followed the rapporteur’s line on the Doyle report and regard Article 175 as the right legal basis, on the grounds that Austria and Denmark have already adopted wholesale bans on the use of these f-gases, and their experiences show that alternatives to them are, in principle, technically and economically workable and that these have a far less damaging effect on the environment.
- (DE) Monsieur le Président, je tiens à souligner que j’ai suivi la position du rapporteur sur le rapport Doyle et que je considère l’article 175 comme une base juridique appropriée, sachant que l’Autriche et le Danemark ont d’ores et déjà adopté une interdiction générale portant sur l’utilisation de ces gaz fluorés. Leur expérience démontre que les alternatives sont, en principe, techniquement et économiquement viables et qu’elles possèdent un effet nettement moins nocif pour l’environnement.

In this context it can be noted that the Council Framework Decision of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States [20], adopted after the Framework Decision on combating fraud and counterfeiting of non-cash means of payment, does not allow that nationality be a ground for refusal with the temporary exception of Austria.

The Group of the European People's Party (Christian Democrats) and European Democrats regrets the fact that, eight years after Austria's accession to the European Union, no solution satisfactory to all parties – on economic as much as on ecological grounds – has yet been found to the problem of goods transport through the Austrian Alps.
- (DE) Monsieur le Président, je souhaiterais apporter au nom de notre groupe une explication de vote au sujet du rapport Caveri : le groupe du Parti populaire européen (chrétiens-démocrates) et des démocrates européens déplore que huit ans après l’adhésion de l’Autriche à l’Union européenne, aucune solution satisfaisante n’ait encore été trouvée pour toutes les parties concernées par le transport de marchandises transitant par les Alpes autrichiennes, du point de vue économique comme du point de vue écologique.

Mr President of the Council, how can you expect Germany to give ground on asylum and immigration policies? How can you expect Spain to give ground on the cohesion issue? How can you expect Austria to give ground on transport policy? How do you expect the United Kingdom to give ground on fiscal policy, when the presidency, the French Republic, is not budging?

(67) It should also be noted that certain other Member States (Austria, France) have limited the number of arms allowed without national authorisations in this context on practical grounds arguing that it would be very unusual for a hunter or marksman to have several firearms with them when travelling.
