Question No. 245 Hon. Irwin Cotler: With regard to the case of Sergei Magnitsky: (a) is the government preparing a list containing the names of any individual that it has reasonable grounds to believe (i) is responsible for the detention, abuse or death of Sergei Magnitsky, (ii) has conspired to defraud the Russian Federation of taxes on corporate profits through fraudulent transactions and lawsuits against the foreign investment company known as Hermitage and to misappropriate property owned or controlled by Hermitage, (iii) has participated in efforts to conceal the legal responsibility of those individuals involved in the detention, abuse or death of Sergei Magnitsky or the existence of the conspiracy referred to in point (ii); (b) if the government is preparing a list as per (a), does the list include the names of the 60 senior Russian officials included by the Commission on Security and Cooperation in Europe on its list entitled “Individuals involved in the tax fraud against Hermitage and the torture and death of Sergei Magnitsky”; (c) does the government plan to declare as ineligible for visas any foreign national whose name appears on the list referred to in (a), as well as the members of the foreign national’s immediate family; and (d) does the government plan to revoke the permanent or temporary resident status of any foreign national whose name appears on the list referred to in (a)?

Emphasises once again the importance of making the handbook for the implementation of the Guidelines available to human rights defenders on the ground; encourages COHOM to disseminate translations of the European Union Guidelines for Human Rights Defenders in European Union languages that are the lingua franca in third countries and in key non-European Union languages amongst regional desks and embassies/delegations; welcomes the fact that, so far, translations are available in languages such as Russian, Arabic, Chinese and Farsi but stresses that more translations need to be produced locally; urges European Union Member States to simplify the issue of visas to human rights defenders who are invited to attend events organised within the European Union or who are fleeing worsening security conditions;
souligne une fois encore qu'il est important de mettre le manuel de mise en œuvre des lignes directrices à la disposition des défenseurs des Droits de l'homme sur le terrain; encourage le COHOM à diffuser des traductions des lignes directrices de l'Union européenne à l'intention des défenseurs des Droits de l'homme dans les langues de l'Union qui constituent la langue véhiculaire dans des pays tiers, ainsi que dans des langues majeures autres que celles de l'Union, parmi les bureaux régionaux et les ambassades ou délégations; se réjouit qu'à présent, des traductions soient disponibles en certaines langues, comme le russe, l'arabe, le chinois ou le persan, mais souligne qu'il est nécessaire de faire localement davantage de traductions; presse les États membres de l'Union de simplifier les formalités d'octroi de visas aux défenseurs des Droits de l'homme invités à assister à des événements organisés dans l'Union ou fuyant du fait de conditions de sécurité qui empirent.

Citizens of the European Union and of the Russian Federation who have lost their identity documents, or from whom these documents have been stolen while staying in the territory of the Russian Federation or the Member States, may leave that territory on the grounds of valid identity documents entitling to cross the border issued by diplomatic missions or consular posts of the Member States or of the Russian Federation without any visa or other authorisation.
