In the light of the Court ruling, the Commission has today adopted a revised decision, in which it confirms its view that aid which the Land of Bremen granted in 1991 to Bremer Vulkan (now in liquidation) towards the purchase of Krupp Atlas Elektronik , a manufacturer of electronic systems for shipping and defence, was incompatible with the common market.
À la lumière de l'arrêt de la Cour, la Commission a adopté aujourd'hui une décision révisée dans laquelle elle confirme son point de vue selon lequel les aides accordées en 1991 par le Land de Brême à Bremer Vulkan (aujourd'hui en liquidation) afin de permettre à cette dernière d'acheter Krupp Atlas Elektronik, fabriquant de systèmes électroniques destinés à la navigation et aux activités de défense, étaient incompatibles avec le marché commun.

The Commission has now completed its inquiries; it has found that aid which the Land of Bremen granted to Bremer Vulkan towards the purchase of Krupp Atlas Electronik was incompatible with Article 92 of the Treaty.

The financial transactions concerned are: - Bremer Vulkan's purchase in April 1987 of 600,750 shares in Seebeckwerft AG from the publicly owned Hanseatische Industrie - Beteiligungen GmbH (HIBEG); - HIBEG's intervention in the contribution of new capital to Bremer Vulkan in June-September 1987, partly by providing a guarantee for the minimum purchase price of the new share issue, partly by finally taking over 96% of these shares; - HIBEG's purchase in 1988 of financial assets from Bremer Vulkan and Seebeckwerft, mainly consisting of shares in different ships previously constructed by these yards; - State guarantees of up to DM 165.1m (80mecu) provided by the Land of Bremen for the restructuring of the Bremer Werftenverbund in addition to aid granted according to the approved terms of the Guidelines for Restructuring Aid for yards in the coastal Läender.

In the case of the part played by HIBEG in the 1987 share issue by Bremer Vulkan, the Commission concluded that the guaranteed issue price exceeded the market value of the shares at that time by about 10% and that the grant element in the transaction therefore was in the order of DM 13.9m.
Pour ce qui est du rôle joué par HIBEG dans l'émission d'actions de Bremer Vulkan en 1987, la Commission a conclu que le prix d'émission garanti était supérieur d'environ 10 % au cours des actions à cette date et que l'élément d'aide contenu dans la transaction était par conséquent de l'ordre de 13,9 millions de DM.

In 1994 Bremer Vulkan Werft signed the contract for construction of the large cruise vessel "Costa I" which has been launched recently. The yard suffered heavy losses under this contract as the sales price amounts to about 600 mio DM but costs exceeded by far 700 mio DM. To finance the construction of the ship, the yard received a grant of 40.6 mio DM plus construction-financing guarantees of 220 mio DM and 40.7 mio DM, out of the guarantee fund of the Land Bremen.
