On 19 November 2009, the Commission found that Italy needed to partially recover a subsidy granted to Alcoa in the form of a preferential electricity tariff for its two Italian aluminium smelters (Sardinia and Veneto), because the tariff provided an unfair advantage to Alcoa over its competitors.

Although the measure was compensation which did not confer any advantage on the recipients throughout the duration fixed by the initial measure (that is, until 1992), the tariff granted as from 2005 constituted State aid.

(b) In order to counteract the serious economic disadvantages resulting from this geographical situation, Moscow created the Free Economic Zone in 1991 and, following its dissolution in 1995, the Kaliningrad Special Economic Zone (SEZ), granting Kaliningrad favourable tax treatment and tariff advantages for imports and exports (including to the Russian 'mainland').

Against this background, the report envisages the following system: - any group of shipowners that has sufficiently pooled its activities (in conjunction with land transporters where appropriate) to bring about advantages for users on the land part could propose a uniform (multimodal) land tariff and be granted an individual exemption, attributed on a case-by-case basis; - any other shipping line not having so pooled activities could only have an individual (multimodal) inland tariff based on its negotiations with inland carriers.
