1. The relevant provisions of Directives 91/496/EEC and 97/78/EC which govern matters referred to in Article 47(2), Article 48, points (b), (c) and (d) of Article 51(1), point (a) of Article 53(1), Article 54(1) and (3), and point (a) of Article 58 of this Regulation shall continue to apply instead of the corresponding provisions of this Regulation until 14 December 2022 or an earlier date to be determined in the delegated act adopted in accordance with paragraph 2 of this Article.

14.1 (1) For the purpose of supporting the attainment of economic goals established by the Government of Canada, the Minister may give instructions establishing a class of permanent residents as part of the economic class referred to in subsection 12(2) and, in respect of the class that is established, governing any matter referred to in paragraphs 14(2)(a) to (g), 26(a), (b), (d) and (e) and 32(d) and the fees for processing applications for permanent resident visas or for permanent resident status and providing for cases in which those fees may be waived.
14.1 (1) Afin de favoriser l’atteinte d’objectifs économiques fixés par le gouvernement fédéral, le ministre peut donner des instructions établissant des catégories de résidents permanents au sein de la catégorie « immigration économique » visée au paragraphe 12(2) et, à l’égard des catégories ainsi établies, régissant les éléments visés aux alinéas 14(2)a) à g), 26a), b), d) et e) ainsi que 32d) et les frais d’examen de la demande de visa ou de statut de résident permanent, et prévoyant les cas de dispense de paiement de ces frais.

(4) Where the government of a province providing a comprehensive pension plan requests the Government of Canada to enter into an agreement under this section with the government of a country under any law of which provision is made for the payment of old age or other benefits including survivors’ or disability benefits, the Minister, with the approval of the Governor in Council, may enter into an agreement with the government of that country for the making of reciprocal arrangements relating to any of the matters referred to in subsection (1) with respect to the provincial pension plan of that province, if that plan makes provision for entering into such an agreement and for the carrying out of the provisions thereof, including the making of any financial adjustment required to be made for that purpose and the crediting or charging of the amount of any such adjustment to the appropriate account or accounts established under that plan.

The respective regulatory authorities of the two Governments will consult from time to time on relevant matters arising under this Agreement, particularly on the matters referred to in paragraphs 4, 5 and 6, relating to tariffs for the transportation of gas through the Pipeline.

(7) Subsections (1) and (2) do not apply to a participant if a government institution referred to in paragraph (6)(c) advises the participant that it is not necessary, in order to prevent disclosure of the information referred to in that paragraph, to give notice to the Attorney General of Canada under subsection (1) or to raise the matter with the person presiding under subsection (2).

Is it acceptable, in 1998, in a democracy, for a government to refer such matters to a court, its own creation, consisting of a panel of nine judges appointed by the federal government itself? To reinforce that argument, one just has to look at the very close ties that the last two judges appointed to the Supreme Court have to the Liberal Party. Is it normal, is it acceptable, in 1998, in a democracy such as Canada, for a federal court consisting of a panel of nine judges appointed by the government to be asked to substitute itself for the democratic will of 7 million Quebeckers?

For the purposes of this Regulation, references to rights and obligations constituting the terms and conditions governing the issuance, offers to the public or public take-over bids of transferable securities and references to the subscription and redemption of units in collective investment undertakings should include the terms governing, inter alia, the allocation of securities or units, rights in the event of over-subscription, withdrawal rights and similar matters in the context of the offer as well as those matters referred to in Articles 10, 11, 12 and 13, thus ensuring that all relevant contractual aspects of an offer binding the issuer or the offeror to the consumer are governed by a single law.

5. The Swiss Government's representatives shall have the right to put forward suggestions in the Mixed Committee as regards the matters referred to in paragraph 1.

In this case the decision shall be suspended and the matter referred to the Commission for a review of its legality, together with the view of the Governing Board.
