In a recent commentary on the Supreme Court's opinion on Senate reform titled " The Supreme Court ruling on the Senate was good for minorities," constitutional lawyer Jennifer Klinck notes, " The structure of government itself strikes a delicate balance between the interests of the federal government and the provinces, and between those of the majority and minorities" .

In this regard, the Court of Justice finds that, under the Spanish procedural system, a consumer who brings proceedings seeking solely rescission of the contract for the sale of goods is definitively deprived of the possibility of benefitting from the right to seek an appropriate reduction in the price of those goods in the event that the court dealing with the dispute should find that, in fact, the lack of conformity in those goods is minor.

8. Notwithstanding sections 4 to 7, where any goods are originating goods under the NAFTA Rules of Origin Regulations and the country of origin of the goods is not determined to be a single NAFTA country under section 4 or 5, the country of origin of those goods shall be the last NAFTA country in which the goods underwent production, other than by minor processing, if a Certificate of Origin under the Proof of Origin of Imported Goods Regulations has been completed and signed for the goods.

Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees must be interpreted as precluding legislation of a Member State, such as that at issue in the main proceedings, which does not allow the national court hearing the dispute to grant of its own motion an appropriate reduction in the price of goods which are the subject of a contract of sale in the case where a consumer who is entitled to such a reduction brings proceedings which are limited to seeking only rescission of that contract and such rescission cannot be granted because the lack of conformity in those goods is minor, even though that consumer is not entitled to refine his initial application or to bring a fresh action to that end.

It will (a) establish a mechanism for networking and exchanging good practice between the Member States, accession countries and relevant international organisations on improving the access and appropriateness of health care services, health promotion and prevention to meet the needs of migrants, the Roma and other vulnerable ethnic minority groups, including irregular/illegal migrants; (b) document the legal and policy framework, including review of national health plans and support for the development and monitoring of national action plans for migrants/ethnic minorities to include a specific focus on the Roma; (c) develop benchmarking criteria and consensus guidelines on good practice on access to care for the Roma and other vulnerable ethnic minority and migrant groups; and (d) review training and capacity building programmes in relation to ethnic/migrant health and development of a consensus framework for capacity building for professionals, including basic components of a training programme and the operational aspects of its delivery and evaluation.
