(2) The President shall not specify or estimate anything pursuant to subparagraph (1)(b)(iii) where the President is of the opinion that, having regard to the country that is providing the export subsidy, the nature of the goods on which there is an export subsidy and the circumstances under which the export subsidy is provided, provision of the export subsidy in relation to those goods is not inconsistent with that country’s obligations under the international agreement known as the General Agreement on Tariffs and Trade, 1994.

(2) Notwithstanding section 24 of the Customs Tariff, the Minister may, subject to any prescribed conditions, deny or withdraw preferential tariff treatment under an agreement set out in column 1 of Part 2 of the schedule in respect of goods for which that treatment is claimed if the exporter or producer of the goods has made false representations that identical goods exported or produced by that exporter or producer and for which that treatment was claimed were eligible for that treatment.

In order to ensure trade mark protection and combat counterfeiting effectively, and in line with international obligations of the Union under the framework of the World Trade Organisation (WTO), in particular Article V of the General Agreement on Tariffs and Trade (GATT) on freedom of transit and, as regards generic medicines, the ‘Declaration on the TRIPS Agreement and public health’ adopted by the Doha WTO Ministerial Conference on 14 November 2001, the proprietor of an EU trade mark should be entitled to prevent third parties from bringing goods, in the course of trade, into the Union without being released for free circulation there, where such goods come from third countries and bear without authorisation a trade mark which is identical or essentially identical with the EU trade mark registered in respect of such goods.

The provisions of this Agreement may be applied to goods which comply with the provisions of this Annex and which on the date of entry into force of this Agreement are either in transit or are in the Community or in Chile in temporary storage in customs warehouses or in free zones, subject to the submission to the customs authorities of the importing country, within four months of the said date, of a movement certificate EUR.1 issued retrospectively by the customs authorities or competent governmental authorities of the exporting country together with the documents showing that the goods have been transported directly in accordance with the provisions of Article 12.
Les dispositions du présent accord peuvent s'appliquer aux marchandises satisfaisant aux dispositions de la présente annexe qui, à la date d'entrée en vigueur du présent accord, se trouvent en transit ou sont temporairement entreposées dans la Communauté ou au Chili dans des entrepôts douaniers ou des zones franches et pour lesquelles un certificat de circulation des marchandises EUR.1 délivré a posteriori par les autorités douanières ou les autorités gouvernementales compétentes du pays d'exportation doit être présenté aux autorités douanières du pays d'importation dans un délai de quatre mois à compter de la date précitée, conjointement avec les documents prouvant que ces marchandises ont fait l'objet d'un transport direct conformément aux dispositions de l'article 12.
