It must, however, be pointed out that the fact that the Board of Appeal did not reproduce all of the arguments of one party and the evidence provided by that party, or did not reply to each of those arguments and items of evidence, cannot by itself lead to a finding that the Board of Appeal refused to take them into account (judgment of 9 December 2010 in Tresplain Investments v OHIM — Hoo Hing (Golden Elephant Brand), T‑303/08, ECR, EU:T:2010:505, paragraph 46).
Il convient toutefois de relever que la circonstance que la chambre de recours n’a pas repris l’ensemble des arguments d’une partie et des éléments de preuve produits par celle-ci ou n’a pas répondu à chacun de ces arguments et éléments de preuve ne permet pas, à elle seule, de conclure que la chambre de recours a refusé de les prendre en considération [arrêt du 9 décembre 2010, Tresplain Investments/OHMI – Hoo Hing (Golden Elephant Brand), T‑303/08, Rec, EU:T:2010:505, point 46].
