The Court of Justice of the European Communities, giving judgment today on an action brought by the Commission, has held that this sectoral traffic ban in the Tyrol obstructs the free movement of goods, particularly their free transit; the measure concerns a road section of the utmost importance, constituting one of the main land routes between the south of Germany and the north of Italy.
La Cour de justice des Communautés européennes, saisie par la Commission, constate dans son arrêt d’aujourd’hui que cette interdiction sectorielle de la circulation dans le Tyrol gêne la libre circulation des marchandises et, en particulier, leur libre transit. En effet, cette mesure concerne un tronçon routier de première importance, constituant l’une des principales voies de communication terrestre entre le sud de l’Allemagne et le nord de l’Italie.
