Other international legal instruments deal with children in conflict situation, in particular the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflicts[2], the Geneva Convention IV of 1949 relative to the Protection of Civilian Persons in time of war[3], the Protocols I + II Additional to the Geneva Convention of 1949 and relating to the Protection of Victims of Armed Conflicts[4], all of which recognise specific needs of protection for children, together with the Statute of the International Criminal Court which defines as a war crime the enrolment of children under the age of 15 in national armed forces or the use of them as active participants in hostilities[5].

Generally speaking, the presence of individual persecution (the key element of the Geneva Convention) is not in fact the sole ground on which asylum is granted in Europe, even if the Geneva Convention is the central pillar of the edifice.

However, several Member States implementing one of or both these optional provisions have failed to transpose Article 14(6)[37], although some are reported to afford the Geneva Convention rights as a result of the "direct effect of the Geneva Convention" (BE) or for other non-specified reasons (AT) which does not constitute sufficient transposition of the Directive provision.

3.1. By way of derogation from Articles 4 and 7, Member States may authorise seamen holding a seafarer's identity document issued in accordance with the Geneva Convention of 19 June 2003 (No 185), the London Convention of 9 April 1965 and the relevant national law, to enter into the territory of the Member States by going ashore to stay in the area of the port where their ships call or in the adjacent municipalities without presenting themselves at a border crossing point, on condition that they appear on the crew list, which has previously been submitted for checking by the competent authorities, of the ship to which they belong.
3.1. For the Member States which are Contracting Parties to the Geneva Convention, Europol shall, in accordance with the Declaration in the Annex (hereinafter referred to as the Declaration), act as the central office for combating euro counterfeiting within the meaning of the first sentence of Article 12 of the Geneva Convention.
