The adaptation of certain provisions of Council Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund (1) is necessary in order to facilitate the mobilisation of Community financial resources for the start-up of operational programmes and assisted projects within the framework of these programmes in such a manner as to accelerate implementation and the impact of such investments on the economy.
L’adaptation de certaines dispositions du règlement (CE) no 1083/2006 du Conseil du 11 juillet 2006 portant dispositions générales sur le Fonds européen de développement régional, le Fonds social européen et le Fonds de cohésion (1) est nécessaire afin de faciliter la mobilisation des ressources financières de la Communauté pour le démarrage des programmes opérationnels ainsi que des projets subventionnés dans le cadre de ces programmes, de manière à accélérer la mise en œuvre et les effets de tels investissements sur l’économie.

However, the Commission cannot exclude out of hand the possibility that certain assets in the industrial sector have been financed under Article 39 CA of the General Tax Code in accordance with the conditions laid down by the guidelines on national regional aid (89), including the condition that the investment be carried out in a region eligible under Article 88(3)(a) or (c) of the Treaty and the condition that the recipient’s contribution to the financing of the investment be at least 25 %.
Cependant, la Commission ne saurait d'emblée exclure l'hypothèse selon laquelle certains biens, relevant du secteur industriel, financés en application de l'article 39 CA du CGI, l'aient été dans le respect des conditions prescrites par les lignes directrices concernant les aides d'État à finalité régionale (89) à savoir, notamment, que l'investissement soit réalisé dans une région éligible au titre de l'article 88, paragraphe 3, point a) ou c), du traité et que l'apport des bénéficiaires destiné au financement en cause atteigne au minimum 25 %.

Notwithstanding Article 7 of Regulation (EC) No 1257/1999, in the case of the outermost regions, the total value of the aid for investments intended in particular to encourage diversification, restructuring or a shift towards sustainable agriculture on agricultural holdings of small economic size, to be defined in the programme complement referred to in Articles 18(3) and 19(4) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds , expressed as a percentage of the volume of eligible investments, shall not exceed 75 %.
