In cases where an investment firm providing portfolio management services is required to provide clients or potential clients with information on the types of financial instruments that may be included in the client portfolio and the types of transactions that may be carried out in such instruments, such information should state separately whether the investment firm will be mandated to invest in financial instruments not admitted to trading on a regulated market, in derivatives, or in illiquid or highly volatile instruments; or to undertake short sales, purchases with borrowed funds, securities financing transactions, or any transactions involving margin payments, deposit of collateral or foreign exchange risk.

The Commission should be empowered to adopt the measures necessary for the implementation of Directive 2004/109/EC in order to clarify the technical aspects of some of the definitions provided under that Directive, notably the maximum length of the usual short settlement cycle, the calendar of trading days, the circumstances under which a person should have learnt of the acquisition or disposal of voting rights, the conditions of independence to be respected by market makers and management companies; take account of technical developments in financial markets; clarify the nature of the auditor’s review, to define the minimum content of the condensed set of solo financial statements; elaborate further the procedures for the notification and disclosure of major holdings as well as the procedures for filing regulated information with the competent authority of the issuer’s home Member State; and define minimum standards for the dissemination of regulated information and for the setting up of storage mechanisms.

to evaluate, by end 2005, the potential for the provision of financial and non-financial incentives in order to encourage fishermen to move towards more environmentally friendly fishing methods; to submit, as soon as practicable, after consultation with stakeholders including the relevant Regional Advisory Councils, a simplified Proposal for technical conservation measures for the Atlantic and North Sea; to give a high priority to schemes promoting and evaluating environmentally-friendly fishing, including, where appropriate, the development and use of more selective gears, compensation for short-term losses for vessels participating in trials of more environmentally-friendly fishing methods, and the training and education of fishermen; when introducing significant new proposals on environmentally friendly fishing methods, to carry out, as appropriate and on the basis of available information, an assessment of possible economic and social impacts covering an evaluation of both short and long-term effects and consider temporary remedial measures that may be required; to develop a pilot project to address the problem of ghost fishing in Community waters which will include a retrieval system to remove lost gears, gear adjustments that lessen the impact of lost gears and methods to reduce the losses of gears; to request ICES , STECF , SAC and other relevant scientific bodies to broaden the scope of their advice to provide eco-system-based advice for fisheries management; to report to the Council and to the European Parliament during 2007 on the implementation and impact of the actions set out in these conclusions".
