It is submitted that the case of Pringle (2) upon which the General Court relied (3), decides that whereas the Commission and the ECB solely commit the ESM (4), nevertheless at inter alia (5) paragraph 164 of that case the court observed that the ‘tasks allocated to the Commission by the ESM Treaty enable it, as provided in 13(3) and 13(4) of that treaty, to ensure that the memoranda of understanding concluded by the ESM are consistent with EU law’ and at paragraph 174 that ‘under Article 13(3) of the ESM Treaty the MoU which is to be negotiated with the Member State requesting stability support must be fully consistent with EU law’.

Moreover, while the Council, on its own admission, took into account other information to be found in a separate confidential document, the General Court observes that the Member State which proposed the listing and supplied that information is opposed to its disclosure, either wholly or in part.

In so far as concerns the question whether the Commission had jurisdiction under international law to punish Intel for its anti‑competitive conduct, the General Court observes that such jurisdiction can be established on the basis of both the implementation and the effects of the anti‑competitive conduct in the European Union.

The General Court observes, in addition, that scraped-off material is less readily accessible by a child than dry or liquid material.

Viasat observes that, in its judgment, the General Court considers solely the interpretation of the contested decision which the Commission, in the General Court’s view, ought to have submitted in its written pleadings before the General Court, without examining the statement of reasons in the contested decision.

The Court observes that, in the present case, the General Court correctly found that the trustee, B., as president of the firm S., had carried out the duties of a member of the executive board of the legal entity responsible for managing the assets sold and that the same firm had been appointed as trustee.

The persons referred to in Article 23 of the Statute of the Court of Justice of the European Union and the parties to the proceedings before the General Court of the European Union are invited to lodge their written observations on those questions at the Court of Justice of the European Union within one month of the service of the present decision.

However, after the statements of case or written observations referred to Article 23 of the Statute have been submitted, the Court, acting on a report from the Judge-Rapporteur, after informing the persons who under the aforementioned provisions are entitled to submit such statements or observations, may, after hearing the Advocate General, decide otherwise, provided that none of those persons has submitted an application setting out the reasons for which he wishes to be heard.
