Objet: Recours, introduit au titre de l’article 270 TFUE, applicable au traité CEEA en vertu de son article 106 bis, par lequel BN demande, d’une part, l’annulation de la décision du Parlement européen du 20 mars 2012 mettant fin à ses fonctions de conseiller auprès du directeur de la direction des ressources de la direction générale (DG) du personnel et la réaffectant, avec effet au 15 mars 2012, à un poste de conseiller auprès du service « Système de management environnemental et d’audit » de l’unité de coordination générale de la direction des ressources de la DG des infrastructures et de la logistique (ci-après le « service EMAS ») ainsi que de la décision du 21 septembre 2012 rejetant la réclamation introduite contre la décision du 20 mars 2012 et, d’autre part, la réparation du préjudice subi du fait d’agissements de harcèlement et de mauvaise administration de la part de sa hiérarchie, chiffré ex æquo et bono à la somme de 400 000 euros.

However, this should not lead to a situation where Member States have a general duty to prevent statutory auditors or audit firms from providing non-audit services to their audit clients. For the purposes of determining whether it is appropriate, in cases of self-interest or self-review, that a statutory auditor or audit firm should not carry out statutory audits, so as to safeguard the statutory auditor's or audit firm's independence, the factors to be taken into account should include the question whether or not the audited public-interest entity has issued transferable securities admitted to trading on a regulated market within the meaning of point 14 of Article 4(1) of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments .
