Article 5 of the Steel Aids Code stipulates that any aid project proposed under general regional investment aid schemes may be compatible with the common market, provided that the benefiting undertaking is located in the territory of the former GDR, that the aid is accompanied by a reduction of the overall production capacity of that territory, and that the aid is granted not after 31.12.1994 (31.12.1995 for the tax allowance for investment as laid down in Article 1 of the Code).

The Commission examined the application of these schemes to the steel industry in the former GDR with the provisions of the Steel Aids Code, and in particular its Article 5, which allows aid under general regional investment aid schemes to be granted to steel undertakings in the former GDR if the aid is accompanied by a reduction in the overall production capacity of that territory.
