Recalls the legally binding nature of the Charter of Fundamental Rights of the European Union; calls on the Commission as the Guardian of the Treaties to effectively monitor compliance with Article 2 TEU and the EU Charter of Fundamental Rights’ legal principles and to ensure the implementation of EU law by the Member States in accordance with the Charter; asks the Commission to use the expertise of the European Union Agency for Fundamental Rights to identify violations of Article 2 TEU in conjunction with the Charter and to start the infringement procedures where such violations occur;

This situation was identified by the European Council in the Stockholm Programme, which calls on the EU institutions and Member States to ensure that legal initiatives remain consistent with fundamental rights " throughout the legislative process by way of strengthening the application of the methodology for a systematic and rigorous monitoring of compliance with the Convention and the rights set out in the Charter of Fundamental Rights "[17].

The third paragraph of Article 47 of the Charter of Fundamental Rights of the European Union (the Charter), Article 6(3)(c) of the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and Article 14(3)(d) of the International Covenant on Civil and Political Rights (ICCPR) enshrine the right to legal aid in criminal proceedings in accordance with the conditions laid down in those provisions.
