17.2 No railway company shall operate or maintain a railway, including any railway work or railway equipment, and no local railway company shall operate railway equipment on a railway, otherwise than in accordance with a railway operating certificate and — except to the extent that the company is exempt from their application under section 22 or 22.1 — with the regulations and the rules made under sections 19 and 20 that apply to the company.

(2) If the railway line, or any interest of the railway company in it, is sold, leased or otherwise transferred by an agreement entered into through the process set out in sections 143 to 145 or otherwise, the railway company that conveyed the railway line has no obligations under this Act in respect of the operation of the railway line as and from the date the sale, lease or other transfer was completed and has no obligations with respect to any operations by any public passenger service provider over the railway line as and from that date.

The said works may be constructed upon property from time to time owned, acquired or taken by the Company, and, in so far as may be necessary, upon the property of any other Company comprised in the Canadian National Railways operating within the territory described in section two of this Act, and, without restricting the generality of the aforegoing language, upon the property of the Canadian Northern Railway Company, the Canadian Northern Ontario Railway Company, the Canadian Northern Quebec Railway Company, the Mount Royal Tunnel and Terminal Company, Limited, the Canadian National Realties, Limited, and, with the approval of the Governor in Council evidenced by the approval of plans under the provisions of section seven of this Act, upon the property owned or taken by His Majesty the King in the right of the Dominion of Canada.

Continuing with our record on railway safety improvement, we have issued emergency directives, protective directives and ministerial orders requiring, among other things, all railway companies to further enhance the safety of their operations and the security of railway transportation; any person who imports or offers for transport crude oil to conduct proper classification testing; the railway companies to share information with municipalities, which will further support municipal emergency planners and first responders; the railway companies to reduce the speed of trains carrying dangerous goods and implement other key operating practices; and the removal of the least crash-resistant DOT-111 tank cars from dangerous goods service.

2. Where more than one railway undertaking licensed in accordance with Article 17, or, in the case of Ireland and Northern Ireland, a railway company so licensed elsewhere, submits an official application to operate competing railway services in, to or from Ireland or Northern Ireland, the continued applicability of this derogation shall be decided upon in accordance with the advisory procedure referred to in Article 62(2).

It is important however that safety is at the very least maintained during the current railways restructuring phase, which will separate functions of previously integrated railway companies and move the railway sector further from self-regulation to public regulation.
