It follows from Council Decision 2001/822/EC of 27 November 2001 on the association of the overseas countries and territories with the European Community (‘Overseas Association Decision’) , that legal entities of the overseas countries and territories are eligible to participate in the Seventh Framework Programme.

Various forms of tax exemption have been made available in the French overseas departments, more especially the "Pons law", which makes it possible to deduct overseas investments from taxable income.

European regulations have therefore been introduced to: - modify the system of dock dues in the overseas departments while still preserving its key features: * significant budgetary resources for local and regional government, making it an important element in decentralization; * contribution to economic and social development, thanks to the deployment of these resources and the possibility of exemptions in favour of local production to boost or support local economic activities; - retain favourable tax treatment for rum from the overseas departments in metropolitan France; - to maintain different VAT systems in the overseas departments allowing for reduced or zero rates, and to exempt the overseas departments from application of the new Community excise system.

This is the aim of the Poseidom agricultural regulation which provides for specific aid measures worth over ECU 65 million in 1993, including: - measures to make it easier for the overseas departments to obtain supplies of basic agricultural products from the rest of the Community and from developing countries; - aid to support local production in the overseas departments; support both for the traditional sectors of bananas, cane/sugar/rum and for diversification and marketing of local products, particularly tropical products; In the field of foreign trade, the Community has respected the special sensitivity of the markets of the overseas departments, which are the immediate neighbours of the ACP states linked to the Community by the Lomé Conventions and the overseas countries and territories which are also associated with the Community.
