IN-CONTEXT TRANSLATIONS

The General Court erred in its judgment in so far as (i) it was inconsistent with previous judgments handed down on the same question (T-332/06 and C-194/09 P); (ii) when applying Article 107(1) TFEU, it confused two criteria, both necessary to prove the existence of aid, inferring that an advantage was conferred on Alcoa from the mere finding that the resources used were of State origin; (iii) it failed to provide an adequate statement of reasons in so far as it failed to observe that the Commission had erred in assuming that Alcoa had obtained an advantage from the measure and had not, therefore, to that end, carried out a proper economic analysis to calculate the extent of the advantage in this particular case.

The applicant claims that the statement of reasons mentioned in the contested regulation is merely a standard statement of reasons which does not make it possible to follow the reasoning of the Commission, whereas the Commission should have indicated very specifically the considerations justifying moving from a refund of EUR 108,50 per tonne to EUR 0, particularly because it is breaking from its previous decision-making practice.

As regards the position of FC Steaua in the case in the main proceedings, the Court points out that the mere fact that statements such as Mr Becali’s do not come directly from a given defendant is not necessarily a bar to establishing, with respect to that defendant, the existence of ‘facts from which it may be presumed that there has been . discrimination’ within the meaning of the directive.

(28) With respect to the reference made in the agreement between the tax authorities and Refractarios to the "general and social interest in maintaining the jobs", Spain explained that this statement could be regarded as merely formal and, in a way, made necessary by the fact that the agreement constituted an act outside the usual scope of the tax authorities' activities and different from the normal channels for managing the collection of claims, although covered by current legislation.
