Julian Fantino (Minister of International Cooperation, CPC): Mr. Speaker, with regard to (a), mitigation actions and measures taken to protect the interests of the Crown when an organization in receipt of the Canadian International Development Agency, CIDA, funding is under legal protection from creditors include conducting an internal, or contracting an external, review and assessment of potential program, legal, fiduciary and political/reputational risks that may arise; alerting the recipient country ministry or partner institution of potential project impacts; reviewing the contractual and performance terms and conditions of the agreement or agreements signed; based on the assessment and severity of the financial situation, developing a risk mitigation and monitoring plan, usually in consultation with the organization or service provider and their lenders, as well as the recipient country ministry or partner institution, if required; obtaining financial statements, forecasts and operational plans from the organization or service provider to closely monitor and track progress in addressing the situation and returning to normal business operations; ensuring that all advance payments are secured by means of irrevocable bank guarantees issued by acceptable financial institutions and that any financial performance guarantees are enforceable, in case of need; and not entering into any new agreements until such time as the organization or service provider has demonstrated their financial capacity, returned to normal business operations and is no longer under the protection of the courts.

Because the entity referred to in the response to Q-972 was involved in active projects in several countries, CIDA took the following specific measures to protect the interests of the Crown: CIDA established a multi-disciplinary task force to oversee a common, integrated and corporate approach to managing the situation and mitigating potential risks; discussions and meetings were held with senior representatives of the organization, who provided detailed information on the extent and severity of the financial situation, and the likely operational impacts; based on the initial information received, as well as a review of the current status of project implementation, management arrangements and contractual terms and conditions, CIDA completed an internal review and assessment of the fiduciary and other risks across each program; a proactive monitoring and integrated risk management approach was developed and agreed with the organization, which featured open and direct channels of communication at a senior level to provide regular updates on the financial situation and recovery as well as to facilitate the dissemination of information on operational progress across the agency and decision-making on individual projects; in projects where the organization was part of a consortium, the agency agreed, on a non-objection basis, to the transfer or assignment of the lead implementation role to other well-established members or partners, who were jointly and severally liable; for projects where the organization was solely responsible for delivery or implementation, the agency took steps to ensure that all financial and performance guarantees were enforceable, in case of need; as part of its efforts to continue operations and remain a going concern, the organization presented a comprehensive business plan and financial projections that were developed with legal and financial third party advisors, a plan was subsequently validated by independent auditors as part of the due ...

1. A Member State requesting or receiving financial assistance from one or several other States, the IMF, the EFSF, the EFSM or the ESM shall prepare in agreement with the Commission - acting in liaison with the ECB and, where appropriate, with the IMF - a draft macroeconomic adjustment programme which shall build on and substitute any economic partnership programmes under Regulation (EU) No ./2012 [on common provisions for monitoring and assessing draft budgetary plans and ensuring the correction of excessive deficit of the Member States in the euro area], which shall also include annual budgetary target. The draft macroeconomic adjustment programme shall addresses the specific risks emanating from that Member State for the financial stability of the euro area and shall aim at rapidly re-establishing a sound and sustainable economic and financial situation and restoring its capacity to finance itself fully on the financial markets. The draft macroeconomic adjustment programme shall be based on the assessment of the sustainability of the government debt and shall take due account of the recommendations addressed to the Member State concerned under Articles 121, 126, 136 and/or 148 TFEU - and its actions to comply with them - while aiming at broadening, strengthening and deepening the required policy measures. The draft macroeconomic adjustment programme shall respect the practices and institutions for wage formation and industrial relations in the Union and shall, where possible, take into account the national reform programme of the Member State concerned in the context of the Union strategy for growth and jobs. The draft macroeconomic adjustment programme shall fully observe Article 151 TFEU and Article 28 of the Charter of Fundamental Rights of the European Union.

Question No. 413 Mr. Hoang Mai: With regard to the Canada Revenue Agency’s (CRA) response to the provisions of the Internal Revenue Service (IRS) regarding the Foreign Account Tax Compliance Act (FATCA): (a) according to the government’s analysis, do the FATCA provisions comply with the provisions of the Convention Between Canada and the United States of America With Respect to Taxes on Income and on Capital and its amending Protocol (2007); (b) how many citizens from the United States of America will be affected by FATCA, (ii) are there specific Canadian exemptions to FATCA; (c) has Canada negotiated with United States Treasury officials or the IRS following the announcement of FATCA provisions, (i) at what time was the government made aware of these provisions, (ii) how long did it take Canada to respond to the initial creation of FATCA and its implementation, (iii) are there ongoing negotiations in this regard; (d) will Canada inform dual citizens about FATCA and, if so, (i) how, (ii) at what time, (iii) what department or agencies will be responsible; (e) has the government conducted any studies or mandated a task force to look into how much FATCA will cost Canadians and, if so, what are the cost implications resulting from the additional regulations and demands, (i) for the government, (ii) for the CRA, (iii) for Canadian banks, (iv) who will absorb these costs, (v) are there other types of non-financial costs such as efficiency or fairness reductions; (f) which Canadian civil liberties associations or other types of association has the government met with to discuss the privacy implications of FATCA and what actions will the government undertake to protect the fundamental civil liberties of all Canadians in this regard; (g) according to the government’s analysis, do the FATCA provisions comply with the provisions of the Privacy Act or the Personal Information Protection and Electronic Documents Act, and if so, which department undertook this assesment; ...

The Czech Presidency, following on from the activities of its predecessor, is working hard to resolve the problems caused by the current financial and economic crisis and in this context has adopted measures at various levels. It has established a joint framework for Member States, as can be seen for example from the bank rescue plan, the European economic recovery plan, the regulation and supervision of financial markets.

The action plan for financial services endorsed by the Cologne European Council in 1999 lays down a programme of actions and priorities with a view to obtaining maximum advantage from the internal market in financial services, especially as regards the retail or consumer markets. Specific actions are proposed for insurance. In this regard, reference should be made to the proposal for a directive on insurance mediation submitted by the Commission in September 2000, the interpretative communication on the freedom to provide services of general interest in the insurance sector (February 2000), the proposal for a directive on distance selling in financial services, and the work in progress on e-commerce and financial services.
