Il convient donc de modifier en conséquence le règlement (CE) no 552/97 du Conseil du 24 mars 1997 retirant temporairement le bénéfice des préférences tarifaires généralisées à l’union de Myanmar , le règlement (CE) no 1933/2006 du Conseil du 21 décembre 2006 portant retrait temporaire de l’accès de la République du Belarus aux préférences tarifaires généralisées , le règlement (CE) no 1100/2006 de la Commission du 17 juillet 2006 fixant, pour les campagnes de commercialisation 2006/2007, 2007/2008 et 2008/2009, les modalités d’ouverture et de gestion des contingents tarifaires pour le sucre brut de canne destiné à être raffiné, originaire des pays les moins avancés, ainsi que les modalités d’importation des produits énumérés à la position tarifaire 1701 originaires des pays les moins avancés et le règlement (CE) no 964/2007 de la Commission du 14 août 2007 fixant les modalités d’ouverture et de gestion des contingents tarifaires applicables au riz originaire des pays les moins avancés, pour les campagnes de commercialisation 2007/2008 et 2008/2009

5. Until Common Customs Tariff duties on the products under tariff headings 1006 and 1701 are entirely suspended in accordance with paragraphs 2 and 3, a global tariff quota at zero duty shall be opened for every marketing year for products under tariff heading 1006 and subheading 1701 11 10 respectively, originating in the countries benefiting from this special arrangement.
5. 4. From 1 July 2009 home providers shall apply a Euro-SMS tariff to all existing roaming customers automatically, with the exception of such roaming customers who have already made a deliberate choice of a specific roaming tariff or package by virtue of which they benefit from a different tariff for regulated roaming SMS messages than they would have been accorded in the absence of such a choice.

3. From 1 July 2012 roaming providers shall apply a euro-data tariff to all existing roaming customers automatically, with the exception of such roaming customers who have already made a choice of a specific roaming tariff, or who are already on a tariff which is demonstrably lower than the euro-data tariff or who have already made a choice of a package by virtue of which they benefit from a different tariff for regulated data roaming services than they would have been accorded in the absence of such choice.
3. Whereas in order to ensure satisfactory marketing of bananas produced within the Community and of products originating in the ACP States within the framework of the Lomé Convention Agreements, while maintaining traditional trade patterns as far as possible, provision should be made for the annual openin of a tariff quota; whereas, on the one hand, imports of bananas from third countries would be subject to a tariff of ECU 100 per tonne, which corresponds to the current rate under the Common Customs Tariff, and, on the other hand, imports of non-traditional bananas from the ACP would be subject to zero duty in accordance with the abovementioned agreements; whereas provision should be made in order to ensure the adaptation of the amount of the tariff quota based on changes in Community demand recorded in the forecast supply balance;
considérant que, pour permettre une commercialisation satisfaisante des bananes récoltées dans la Communauté ainsi que des produits originaires des États ACP dans le cadre des accords de la convention de Lomé, tout en maintenant autant que possible les courants d'échanges commerciaux traditionnels, il convient de prévoir l'ouverture chaque année d'un contingent tarifaire; que, dans le cadre de ce contingent, d'une part, les importations de bananes « pays tiers » sont assujetties à la perception d'un montant de 100 écus par tonne qui correspond au droit du tarif douanier actuellement pratiqué, d'autre part, les importations des bananes « non traditionnelles ACP » bénéficient d'un droit nul conformément aux accords précités; qu'il y a lieu de prévoir une disposition afin d'assurer la modification du volume du contingent tarifaire en fonction de l'évolution de la demande communautaire constatée dans le bilan prévisionnel;

The general rules for the interpretation of the Common Customs Tariff and the special rules for its application shall apply to the tariff classification of products covered by Regulation No 14/64/EEC ; the tariff nomenclature resulting from application of the said Regulation shall be incorporated in the Common Customs Tariff from the date on which the latter is fully applied.
