In order to deal with situations where an insurance or ancillary insurance intermediary is established in a Member State with the sole purpose of avoiding compliance with the rules of another Member State which is the place where it entirely or principally carries out its activity, the possibility for the host Member State to take precautionary measures may be an appropriate solution where its activity seriously endangers the proper functioning of the insurance and reinsurance market of the host Member State, and should not be prevented by this Directive. However, those measures should not be an obstacle to the freedom to provide services and the freedom of establishment, nor an access barrier to cross-border activity.

To put it more positively, I rise to speak in favour of freedom of expression as guaranteed by section 2(b) of the Canadian charter which includes freedom to fly the Canadian flag, freedom to sing the Canadian national anthem and freedom of speech for members of Parliament inside and outside this House.

By the insertion of the term “proceedings” in the Bill of Rights, Parliament gave statutory authority to what was implied in previous declarations of the privilege of freedom of speech by the Commons, e.g. in the Protestation of 1621, where it is claimed: that in the handling and proceeding of those businesses every member of the House of Parliament hath and of right ought to have freedom of speech to propound, treat, reason and bring to conclusion the same. and that every member of the said House hath like freedom from all impeachment, imprisonment and molestation (other than by censure of the House itself) for or concerning any speaking, reasoning or declaring of any matter or matters touching the parliament or parliament business (1 Rushworth, 53).

That, in the opinion of the House, the government should: (a) continue to recognize as part of Canadian foreign policy that (i) everyone has the right to freedom of religion and conscience, including the freedom to change religion or belief, and the freedom to manifest religion or belief in teaching, worship, practice and observance, (ii) all acts of violence against religious groups should be condemned, (iii) Article 18 of the Universal Declaration of Human Rights and of the International Covenant on Civil and Political Rights be supported, (iv) the special value of official statements made by the Minister of Foreign Affairs denouncing violations of religious freedom around the world be promoted, (v) Canada's commitment to the creation of an Office of Religious Freedom should be used to help protect religious minorities and promote the pluralism that is essential to the development of free and democratic societies; and (b) support (i) the opposition to laws that use " defamation of religion" and " blasphemy" both within states and internationally to persecute members of religious minorities, (ii) reporting by Canadian missions abroad in responding to incidents of religious violence, (iii) coordinated efforts to protect and promote religious freedom, (iv) the maintaining of a regular dialogue with relevant governments to ensure that the issue of religious persecution is a priority, (v) the encouragement of Canadian embassies to seek contact with religious communities and human rights organizations on gathering information related to human rights abuses, (vi) the training and support of foreign affairs officials for the advocacy of global religious freedom.

The European Court of Justice already considered the tax treatment of vehicles rented and registered in one Member State which are in fact used by the lessee in another Member State, where the lessee is resident. In its judgment in case C-451/99 ("Cura Anlagen"), the Court took the view that an obligation to register the vehicle in the Member State of residence does not breach, per se, the provisions on freedom to provide services. However, the vehicle user must be granted a period of time within which to register the vehicle in the Member State of residence which is not so short as to be considered an unjustified obstacle to that freedom (in that case, a period of three days was considered as contrary to the EC Treaty freedom rules). The Court also considered that, in order to comply with the provisions of the Treaty, the imposition of a registration tax on the leased vehicle in the Member State of residence must be proportionate to the period during which the vehicle will be registered and used in that Member State of residence.
