IN-CONTEXT TRANSLATIONS

29. Notes once again with satisfaction the adoption by the United Nations General Assembly of the Declaration on the rights of indigenous peoples, which creates a framework in which States can protect and promote the rights of indigenous people without exclusion or discrimination; urges the Commission, therefore, to follow up on the implementation of the declaration, in particular through the EIDHR, while in particular enjoining all the Member States to ratify as a matter of urgency International Labour Organization (ILO) Convention 169 on Indigenous and Tribal Peoples, which backs up the principles set out in the declaration in question with a legally binding instrument; however, welcomes the Commission's activities targeting indigenous peoples and welcomes the project entitled "Promotion of Indigenous and Tribal Peoples" Rights through Legal Advice, Capacity-Building and Dialogue", initiated as a joint management project between the Commission and the ILO; notes that, almost twenty years after its entry into force, only three Member States have ratified the ILO Convention, namely Denmark, the Netherlands and Spain; consequently, encourages initiatives to increase awareness of this important legislative instrument and to enhance its effectiveness worldwide by ensuring that it is ratified by all the Member States;
29. rappelle sa satisfaction quant à l'adoption par l'Assemblée générale des Nations unies d'une déclaration sur les droits des peuples indigènes, laquelle offre un cadre dans lequel les États pourront protéger et promouvoir les droits des peuples indigènes sans exclusion ni discrimination; prie instamment la Commission de suivre l'application de la déclaration, en particulier grâce à l'IEDDH, tout en recommandant spécifiquement la ratification urgente par tous les États membres de la Convention n° 169 de l'Organisation internationale du travail (OIT) relative aux peuples indigènes et tribaux, qui soutient les principes décrits dans la déclaration mentionnée par un instrument légalement contraignant; se félicite toutefois des actions de la Commission destinées aux peuples indigènes et salue le projet de "promotion des droits des peuples indigènes et tribaux au moyen de conseils juridiques, du renforcement des capacités et du dialogue", géré conjointement par la Commission et l'OIT; relève que, quelque 20 ans après l'entrée en vigueur de la Convention de l'OIT, seuls trois États membres, à savoir le Danemark, les Pays-Bas et l'Espagne, ont procédé à sa ratification; encourage dès lors toutes les initiatives qui viseraient à mieux faire connaître cet instrument législatif important et à en renforcer l'efficacité dans le monde via sa ratification par tous les États membres;

− (SV) We understand that there may be major problems within the construction sector in Spain and that it may be the case that unsuspecting citizens purchase properties in good faith which it later transpires the construction company did not have the legal right to build. However, these are problems that can and should be solved within the Member State’s legal framework.

Some Member States transposed the Framework Decision into domestic laws having more or less the same content as the Framework Decision (Spain, Portugal) while others amended existing provisions or adopted legislation providing for new rules (Denmark, France, Latvia, Hungary, Austria, Finland, Sweden).

Regrets, given the fact that only three Member States (Denmark, Spain and Portugal) have transposed Council Framework Decision 2002/584/JHA of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States , that the European Council failed to insist that the remaining Member States respect the deadline of 31 December 2003; calls once again on the Council to adopt a framework decision on common standards governing procedural law;

From the Commission's perspective, the result is that, when all the amendments still in the process of being drafted or adopted (Austria, France, Luxembourg, Portugal, Spain) enter into force, the Framework Decision will have been transposed in full into national law by all the Member States, with the exception of at least one provision which does not seem to have been completely transposed by certain Member States.
