In relation to the financial corrections imposed by the contested Commission implementing decision of 2 May 2013 on excluding from European Union financing certain expenditure incurred by the Member States under the Guarantee Section of the European Agricultural Guidance and Guarantee Fund (EAGGF), the European Agricultural Guarantee Fund (EAGF) and the European Agricultural Fund for Rural Development (EAFRD), notified under document C(2013) 2436 and published at OJ 2013 L 123, in so far as that decision imposes on the Hellenic Republic a financial correction totalling EUR 6 175 094,49 for expenditure incurred by it within the framework of the European Agricultural Fund for Rural Development, in Axis 2, 2007-13, area related measures in the financial years 2009 and 2010 (claim years 2008 and 2009), the Hellenic Republic puts forward the following pleas for annulment:
Concernant les corrections financières prévues par la décision d’exécution de la Commission du 2 mai 2013 écartant du financement de l’Union européenne certaines dépenses effectuées par les États membres au titre du Fonds européen d’orientation et de garantie agricole (FEOGA), section «Garantie», du Fonds européen agricole européen de garantie (FEAGA) et du Fonds européen agricole pour le développement rural (Feader), notifiée sous le no C(2013) 2436 et publiée au JO L 123/2013, dans la mesure où celle-ci impose à la République hellénique une correction financière d’un montant total de 6 175 094,49 euros pour les dépenses effectuées par la République hellénique dans le cadre du Fonds européen agricole pour le développement rural, Axe 2, 2007-2013, mesures liées à la surface, exercices 2009 et 2010 (années de demande 2008 et 2009), la République hellénique fait valoir les moyens d’annulation suivants:

42. Welcomes the decision to abolish export subsidies in agriculture by 2013 and calls once again for the implementation of decisions already taken to be brought forward significantly; however, as these export subsidies account for only 3.5% of overall EU agricultural support, urges the Commission to continue discussions on finalising the modalities by which agricultural domestic subsidies and tariffs can be reduced in all industrialised countries;
42. se félicite de la décision d'abolir les subventions agricoles à l'exportation à l'horizon 2013 et demande à nouveau de grands progrès dans la mise en œvre des décisions déjà prises; cependant, étant donné que les subventions à l'exportation ne représentent que 3,5% du soutien global que l'Union européenne apporte à son agriculture, invite instamment la Commission à poursuivre les négociations visant à mettre au point des modalités de réduction des subventions agricoles intérieures et des droits de douane dans tous les pays industrialisés;

Whereas by Regulations (EC) No 1926/96 (1), (EC) No 921/96 (2) and (EC) No 340/97 (3) the Community brought forward implementation of the measures contained in the Protocol relating to basic agricultural products, processed agricultural products and fishery products, respectively; whereas, therefore, appropriate measures should be taken to ensure a smooth transition between the preferential arrangements applied under those Regulations and those provided for by the Protocol,

Whereas, with a view to the preservation of biological and genetic diversity in agriculture in the Community, which constitutes an irreplaceable fund of biological and genetic resources, genetic resources should be preserved; whereas all necessary measures should be taken to conserve, characterize, collect and utilize those resources to promote the aims of the common agricultural policy and safeguard biological diversity in line with the Convention on Biological Diversity ratified by the Community in 1993; whereas all forward-looking solutions which might prove necessary should be applied;
