(i) subsections 13(4) and 44(1) of the Act are treated by Spruce Falls as applying in respect of the assignment by Spruce Falls of the Water Power Lease Agreement to Ontario Hydro and the acquisition by Spruce Falls of the Power Rights Agreement as if the Water Power Lease Agreement were a former business property and the Power Rights Agreement were depreciable property acquired as a replacement for that former business property, as those terms are defined for the purposes of the Act, and as if Spruce Falls had elected under subsection 13(4) of the Act as and when required for that subsection to apply with respect to the disposition of the Water Power Lease Agreement and the acquisition of the Power Rights Agreement, and

I am here, Mr. Chairman, to share some observations as a lawyer who has advised clients, big and small, including the commissioner's office, as a former commissioner, a competition policy advocate and a former business executive.

Tonight, this gives us a chance to influence the Commission in advance of its CSR communication by asking it firstly to maintain the open definition of CSR latterly adopted by it in the Multi-Stakeholder Forum; to return to the principle of convergence in private and voluntary CSR initiatives, which was its former policy; to make concrete proposals for implementing global CSR standards, specifically the updated OECD guidelines on Multinational Enterprises and the new Ruggie framework on business and human rights; to commit to the principle of integrated financial, environmental, social and human rights reporting by business – indeed paving the way towards the possibility of future legislation in this area; and to advance the responsibility of European businesses in their global supply chain, responding to the governance gaps identified in the Commission’s own recent Edinburgh study.

5. Commends the efforts made by the government of the former Yugoslav Republic of Macedonia in the economic field, which have resulted in significant progress in fulfilling the economic criteria, thus bringing the country closer to a functional market economy; welcomes in particular the facilitation of the tax payment procedures, reform of one-stop-shop registration, foreign trade facilitation and the cutting of red tape; encourages the government to continue its policies aimed at stable GDP growth, a low inflation rate, fiscal discipline and a strengthening of the overall business climate;
5. salue les efforts du gouvernement de l'ancienne République yougoslave de Macédoine dans le domaine économique, qui se sont traduits par des avancées significatives dans le respect des critères économiques, rapprochant ainsi le pays d'une économie de marché viable; salue notamment la facilitation des procédures de paiement des impôts, la réforme du guichet unique d'enregistrement, la facilitation du commerce extérieur et la réduction des formalités administratives; encourage le gouvernement à poursuivre ses politiques axées sur une croissance stable du PIB, un faible taux d'inflation, la discipline budgétaire et la création d'un climat général plus favorable aux entreprises;

1. Welcomes the progress made by the Former Yugoslav Republic of Macedonia, since its application to become a Member of the European Union, in meeting the Copenhagen political criteria and in implementing the recommendations of the 2004 European Partnership, the provisions of the SAA and the requirements of the Stabilisation and Association Process; points out that the reform momentum must be maintained and that the adopted legislation must now be properly and promptly implemented, especially in the fields of the police, the judiciary, public administration and the fight against corruption, in order to establish a true market economy, to stimulate economic growth and employment and to improve the business climate;
1. salue les progrès réalisés par l'ancienne République yougoslave de Macédoine depuis le dépôt de sa candidature pour devenir membre de l'Union européenne, quant au respect des critères politiques de Copenhague et quant à la mise en œuvre des recommandations du partenariat européen 2004, des dispositions prévues par l'ASA et des exigences du processus de stabilisation et d'association; souligne que la cadence des réformes doit être maintenue et que la législation adoptée doit dorénavant être mise en œuvre rapidement et de manière adéquate, en particulier dans les domaines de la police, de la justice, de l'administration publique et de la lutte contre la corruption, en vue d'établir une vraie économie de marché, de stimuler la croissance économique et l'emploi et d'améliorer le climat des affaires;

We all recall the Shawinigate scandal when the Prime Minister made inappropriate approaches, called the president of the Business Development Bank to lobby for a government loan for a friend, a businessman and former business partner in a golf course that he used to own in his riding. There was an RCMP review of the circumstances.
