To that extent, a tender submitted by a tenderer, in particular under a framework agreement or where a dynamic purchasing system is being used, may take the form of that tenderer's electronic catalogue if the latter uses the means of communication chosen by the contracting entity in accordance with Article 48.

2. For the purposes of this Section, "tendering procedure" shall mean the organisation of a competition among interested parties in the form of an invitation to tender or similar procedure, the contract being awarded to the party submitting the most advantageous tender complying with the rules laid down in this Regulation.
2. Au sens de la présente section, on entend par "adjudication" la mise en concurrence des intéressés sous forme d'appel d'offres ou d'un procédé dérivé de celui-ci, le marché étant attribué à la personne dont l'offre est la plus favorable et conforme au présent règlement.

TENDER PARTICIPATION BY THIRD COUNTRIES (triangularity) In addition to all economic operators from EC Member States and from the beneficiary states, all countries eligible for the PHARE programme and certain Mediterranean countries may participate in TACIS tenders on the following conditions: - they should have traditional, geographic, economic or trade links with the Newly Independent States - the projects concerned should require specific forms of assistance particularly available in those countries - the recipient country should agree to the "triangular" nature of the assistance, which must be marked on the invitations to tender, wher possible - the triangularity should, as a whole, not exceed 10% of the annual budgetary allocation - the triangularity will be decided upon on a case-by-case basis.
