The purpose of this Regulation is to determine the third countries whose nationals are subject to, or exempt from, the visa requirement, on the basis of a case-by-case assessment of a variety of criteria relating, inter alia, to illegal immigration, public policy and security, economic benefit, in particular in terms of tourism and foreign trade, and the Union’s external relations with the relevant third countries, including, in particular, considerations of human rights and fundamental freedoms, as well as the implications of regional coherence and reciprocity’.
L’objet du présent règlement est de déterminer les pays tiers dont les ressortissants sont soumis à l’obligation de visa ou en sont exemptés, sur la base d’une évaluation au cas par cas de divers critères relatifs, entre autres, à l’immigration clandestine, à l’ordre public et à la sécurité, aux avantages économiques, en particulier en termes de tourisme et de commerce extérieur, ainsi qu’aux relations extérieures de l’Union avec les pays tiers concernés y compris, en particulier, des considérations liées au respect des droits de l’homme et des libertés fondamentales ainsi que les implications de la cohérence régionale et de la réciprocité».

(1.1) A designated foreign national whose identity has not been established or in respect of whom the minister has reasonable grounds to suspect that in relation to the arrival in Canada of that foreign national there has been, or will be, a contravention of subsection 117(1) for profit, or for the benefit of, at the direction of, or in association with a criminal organization or terrorist group may not make an application for permanent residence under subsection (1).

Irwin Cotler: With regard to the case of Sergei Magnitsky: (a) is the government preparing a list containing the names of any individual that it has reasonable grounds to believe (i) is responsible for the detention, abuse or death of Sergei Magnitsky, (ii) has conspired to defraud the Russian Federation of taxes on corporate profits through fraudulent transactions and lawsuits against the foreign investment company known as Hermitage and to misappropriate property owned or controlled by Hermitage, (iii) has participated in efforts to conceal the legal responsibility of those individuals involved in the detention, abuse or death of Sergei Magnitsky or the existence of the conspiracy referred to in point (ii); (b) if the government is preparing a list as per (a), does the list include the names of the 60 senior Russian officials included by the Commission on Security and Cooperation in Europe on its list entitled “Individuals involved in the tax fraud against Hermitage and the torture and death of Sergei Magnitsky”; (c) does the government plan to declare as ineligible for visas any foreign national whose name appears on the list referred to in (a), as well as the members of the foreign national’s immediate family; and (d) does the government plan to revoke the permanent or temporary resident status of any foreign national whose name appears on the list referred to in (a)?

Finally, for future revisions of the Annexes of Regulation 539/2001, economic and trade considerations will also be taken into account, in line with the new criteria for assessing visa waivers that the co-legislators will shortly adopt; a new Article will be inserted in Regulation 539/2001 as follows: “The purpose of this Regulation is to determine those third countries whose nationals are subject to or exempt from the visa requirement, based on a case-by-case assessment of a variety of criteria relating, inter alia, to illegal immigration, public policy and security, the economic benefits, in particular in terms of tourism and foreign trade, and the Union’s external relations with relevant third countries including, in particular, human rights and fundamental freedoms considerations, as well as the implications of regional coherence and reciprocity”.
Enfin, pour les futures révisions des annexes du règlement n° 539/2001, des considérations économiques et commerciales seront également prises en compte, conformément au nouveau critère à retenir pour évaluer les exemptions de visa que les colégislateurs adopteront prochainement; un nouvel article sera inséré dans le règlement n° 539/2001, lequel sera libellé comme suit: «Le présent règlement a pour objectif de déterminer les pays tiers dont les ressortissants sont soumis à l'obligation de visa ou en sont exemptés, sur la base de l'évaluation au cas par cas d'une série de critères concernant, entre autres, l'immigration irrégulière, l'ordre et la sécurité publics, les gains économiques, notamment en matière de tourisme et de commerce extérieur, ainsi que les relations extérieures de l'Union avec les pays tiers pertinents, y compris, en particulier, des considérations relatives aux droits de l'homme et aux libertés fondamentales, et les incidences de la cohérence régionale et de la réciprocité».
