This does not preclude the courts there from taking foreign mandatory rules into account, but they would then be acting outside the Convention and the additional details that it contains.

Foreign overriding mandatory rules can be applicable in a variety of situations.

Such a clause could be based on Article 3(3) of the present Convention, which specifies that "where all the other elements relevant to the situation at the time of the choice are connected with one country only", the fact that the parties have chosen a foreign law may not prejudice the application of that country's mandatory rules of law.

(24a) To take account of certain rules of the Member States, in particular those for protection of the family home and for assigning rights of use in relations between the spouses, this Regulation should not prevent the application of overriding mandatory rules by the court before which a matter is brought, and should therefore allow a Member State to set aside the application of a foreign law in favour of its own.

1. Where the appointment of an administrator is mandatory or mandatory upon request under the law of the Member State whose courts have jurisdiction to rule on the succession pursuant to this Regulation and the law applicable to the succession is a foreign law, the courts of that Member State may, when seised, appoint one or more administrators of the estate under their own law, subject to the conditions laid down in this Article.

The fact that the parties have chosen a foreign law in accordance with paragraphs 1 or 2, whether or not accompanied by the choice of a foreign tribunal, shall not, where all the other elements relevant to the situation at the time of the choice are connected with one country only, prejudice the application of rules of the law of that country which cannot be derogated from by contract, hereinafter called “mandatory rules”.
4.
