4. Unless the Member State concerned objects to the Commission’s determination within two months of the entry into force of the decision referred to in paragraph 3, the Member State concerned shall compensate the budget of the Union for the payment of the award or settlement or costs arising from the arbitration within six months of the entry into force of the Commission’s decision.

Taking into account the experience with the previous decisions amending The Arbitration Convention and doubts raised at that time it shall be noted that by specifying the date in the Decision’s text it might give a rise to the risk that the Decision takes the effect later than the date of entry into force specified for the Arbitration Convention (i.e. setting the retroactive date of entry into force of the Arbitration Convention).

That is a poor argument when we need to reduce our handicap in terms of both competitiveness and confidence in market mechanisms, particularly because it has the effect of distorting business strategies, as companies suddenly find themselves forced to arbitrate, for the wrong reasons, between their various subsidiaries and branches.

The Arbitration Convention, as amended by the Protocol of 25 May 1999, the Conventions of 21 December 1995 and of 8 December 2004 and this Decision, shall enter into force on the day following that of the publication of this Decision in the Official Journal of the European Union between Bulgaria, Romania and the other Member States in which the Arbitration Convention is in force.

The Arbitration Convention, as amended by the Protocol of 25 May 1999, the Conventions of 21 December 1995 and of 8 December 2004 and this Decision, enters into force on 1 January 2007 between Bulgaria, Romania and the other Member States for which the Arbitration Convention is in force.

Any dispute arising out of these Internal Regulations or related to them shall be resolved by arbitration in accordance with the arbitration rules of Uncitral (United Nations Commission on International Trade Law) currently in force.

The Association Committee shall, no later than six months after the entry into force of this Agreement, establish a list of at least 15 individuals who are willing and able to serve as arbitrators, a third of whom must not be national of either Party and are identified as chairperson of arbitration panels.

(b) the Association Committee shall, no later than six months after the entry into force of this Agreement, establish a list of at least five individuals who are not nationals of either Party, and who are willing and able to serve as arbitrators and be identified as chairperson of arbitration panels in financial services. The Association Committee shall ensure that the list always contains five individuals at any point in time. Those individuals shall have expertise or experience in financial services law or practice, which may include the regulation of financial institutions, be independent, serve in their individual capacities and not be affiliated with, nor take instructions from, any Party or organisation and shall comply with the Code of Conduct set out in Annex XVI. Such list may be amended every three years.
