(2) For the purpose of determining tax payable in respect of a tour package and for the purposes of Part VI of Schedule VI, the provision of all that part of the taxable portion of a tour package that is not included in the provincially taxable portions of the tour package and the provision of the part of the tour package that is not included in the taxable portion of the tour package are each deemed to be a supply separate from, and not incidental to, the provision of the remaining parts of the tour package.

(2.2) Where a supply of a provincially taxable portion of a tour package in respect of a participating province is made by a supplier who acquired the tour package from another person and was not required to pay tax under subsection 165(2) in respect of the tour package, the supplier is deemed to be the first supplier of the tour package for the purposes of determining the base percentage, initial taxable percentage and taxable percentage, in respect of the provincially taxable portion of the tour package and the non-provincially taxable portion of the tour package.

(b) an eligible pilot is deemed to have been employed and to have rendered services on a full-time basis throughout any year if the number of pilotage tours credited to the pilot for the year is not less than 90 % of the average number of tours for pilots in the year, determined by the Société on the basis of the total number of paid tours for pilots in the year, and is otherwise deemed to have been employed and to have been rendering services on a part-time basis throughout the year, with the proportion of full-time service being determined as the proportion of the number of tours so credited to the average number of tours for pilots;

(g) the tour operator agrees to ensure that, for tours between Canada and a point or points in Bermuda, the Caribbean, the Bahamas, Mexico, Central America or the northern coastal regions of South America including Colombia, Venezuela, Guyana, Surinam, French Guiana and the islands adjacent thereto, the return air transportation of a tour participant from the last stop on the tour itinerary shall not be commenced prior to the 72nd hour after the scheduled hour and day of that participant’s departure from the point of origin of the tour;

In case the legislators reach agreement on the present proposal before there is prospect of imminent agreement on the proposal for a Regulation establishing the touring visa, the provisions in this proposal relating to the envisaged touring visa (Articles 3(7), 12(3), 18(6)) should not be maintained for adoption but be inserted later by an amendment to the Visa Code when agreement on the touring visa proposal has eventually been reached.
