Given that Europol Decision contains a provision which could allow Europol to conclude an agreement or a working arrangement with FRONTEX which may concern the exchange of operational, strategic or technical information, including personal data, the EDPS calls on the legislator to clarify in the proposed Regulation that the working arrangement which could be concluded with Europol on the basis of the proposed Article 13 of FRONTEX Regulation, would exclude the exchange of personal information.

In order to further improve the proposal, the EDPS also calls on the legislator to clarify in the proposed Regulation that the working arrangement which could be concluded with Europol on the basis of the proposed Article 13 of the FRONTEX Regulation, would exclude the exchange of personal information.

The proposed Regulation could provide a more detailed legislative framework in fight against fraud and encourages cooperation with and coordination by the Commission, particularly OLAF.
