Welcomes the Commission’s proposals for a data breach notification system in the e-privacy directive, which should furthermore be applied in a consistent manner in all areas where data protection is required; Calls for a revision and simplification of the current personal data processing notification system beyond the telecom sector to serious data breaches, with a view to ensure that data processing requirements do not place excessive burdens on data controllers and to put an end to diverging national requirements in this field; calls for an extension of the personal data breach notification system beyond the telecom sector to serious data breaches, emphasising the importance of an uniform system for notification of violations;

The main objective of this Decision is to lay down new guidelines that establish the scope of RAPEX and of the notification procedure under Article 11 of Directive 2001/95/EC more clearly, identify the notification criteria and regulate various aspects of the notification and reaction procedures, such as the scope of data provided by the Member States, confidentiality rules, withdrawal of notifications, follow-up action to notifications and organisational aspects.

The offence notification shall contain the subject of the notification, the name of the authority responsible for enforcing the sanctions and the purpose of the notification, the name of the competent authority responsible for applying this Directive, a description of the relevant details of the offence concerned and the amount of the financial penalty that the holder is required to pay, the date by which it must be paid, the possibilities for the holder to contest the grounds for the offence notification, a statement of her/his privileges against self-incrimination and of his/her right to appeal against a decision imposing a financial penalty, and the procedure to be followed in case of dispute or appeal.
