Commission refers SPAIN to the Court of Justice of the EU for failure to implement EU rules on whistle-blowers

In this judgement, the Court found that the obligations for cargo-handling companies in Spanish ports to register with a 'pool company' and to hold shares in that company and to employ as a priority workers provided by that company run counter of Article 49 of the Treaty on the Functioning of the European Union (TFEU). To date, Spain has not adequately addressed the issues identified in the Court's judgment; therefore, the European Commission has decided to refer Spain to the Court of Justice of the EU for failure to comply with the judgement of 11 December 2014. The Commission invites Spain to rapidly undertake the necessary reforms in order to comply with this judgement; otherwise, the Court may decide to impose financial penalties on Spain.

UK ) and the Aruba case (C-300/04, Eman en Sevinger ), the European Court of Justice made the important point that although the Member States have discretion in regulating those aspects of electoral procedure for the European Parliament (EP) elections which are not harmonised at EU level, they must respect general principles of EU law, under the control of the Court of Justice.

In the Judgment of the Court of Justice of the European Communities of 29 April 1999 in Case C-342/96 Spain v Commission (hereinafter Tubacex) (3), the Court considered that the debt rescheduling agreements concluded by the TGSS and FOGASA did not constitute State Aid as those public institutions had acted as a private creditor would have done to try to recover amounts owed to it, provided that the interest rate was at least equal to the rate that a private creditor would have applied (4) and that the rescheduling agreement did not result in new debts being accumulated.

B. The judgment of the Court of Justice of the European Communities of 29 April 1999 in case C-342/96, Spain v. Commission(4), relating to State aid granted by Spain to Tubacex (hereinafter the "Tubacex judgment")

(4) On 29 April 1999 the Court of Justice delivered its judgement in Case C-342/96 Spain v. Commission on State aid granted by Spain in favour of Tubacex (hereinafter the Tubacex judgment). The Court annulled Commission Decision 97/21/ECSC,EC(5), which had declared as incompatible aid to Tubacex the rescheduling agreements between Tubacex and the Social Security Treasury and the repayment agreements between Tubacex and the Fogasa, in so far as the rate of interest was below market rates.
