Following the Commission's letter of formal notice of 17 January, Hungary only proposed a clause that would allow to extend in individual cases the retirement age of a judge beyond 62 if the judge passes a review by the National Judicial Council of his `professional and medical aptitude' and within the limit of a pre-determined annual quota.
À la suite de la lettre de mise en demeure de la Commission du 17 janvier, la Hongrie a seulement proposé d'ajouter une clause qui permettrait de repousser dans certains cas l'âge de la retraite au‑delà de 62 ans si le juge concerné se soumet avec succès à un examen, par le Conseil national de la magistrature, de son «aptitude sur le plan professionnel et médical» et dans les limites d'un quota annuel prédéterminé.

The legal basis for the certification system is Regional Law No 70 of 31 August 1994 (new rules on vocational training), and more specifically Article 11 thereof, which provides for the issue of a vocational training or specialisation certificate for certain training activities following an aptitude test, and Article 18 thereof, which confers on the Regional Council the powers to determine the job profiles included in the regional classification and in respect of which the vocational training or specialisation certificate is issued.
