2. Where applicable, for a flavouring already approved under this Regulation which is prepared by production methods or starting materials significantly different from those included in the risk assessment of the Authority, a producer or user shall, before marketing the flavouring, submit to the Commission the necessary data to allow an evaluation of the flavouring to be undertaken by the Authority with regard to the modified production method or characteristics.

Le cas échéant, le fabricant ou l’utilisateur d’un arôme déjà autorisé en vertu du présent règlement et préparé au moyen de méthodes de fabrication ou de matières premières sensiblement différentes de celles visées dans l’évaluation des risques effectuée par l’Autorité soumet à la Commission, avant la commercialisation de l’arôme, les données permettant à l’Autorité de procéder à une évaluation de cet arôme eu égard à la méthode de fabrication ou aux caractéristiques modifiées.

2. When a flavouring already included in the Community list is produced from a different source falling within the scope of Regulation (EC) No 1829/2003, it will not require a new authorisation under this Regulation, as long as the new source is covered by an authorisation in accordance with Regulation (EC) No 1829/2003 and the flavouring complies with the specifications established under this Regulation.

Quand un arôme figurant déjà sur la liste communautaire, est produit par une source différente entrant dans le champ d’application du règlement (CE) no 1829/2003, il ne requiert pas de nouvelle autorisation au titre du présent règlement, dès lors que la nouvelle source a fait l’objet d’une autorisation conformément au règlement (CE) no 1829/2003 et que l’arôme satisfait aux spécifications établies conformément au présent règlement.

Whenever the evaluation by the Authority indicates that an existing smoke flavouring already on the market in the Member States constitutes a serious risk to human health, this product should be removed from the market without delay.
Lorsque l'évaluation par l'Autorité indique qu'un arôme de fumée existant déjà sur le marché dans les États membres présente un risque sérieux pour la santé humaine, ce produit devrait être retiré du marché sans délai.

(16) Whenever the evaluation by the Authority indicates that an existing smoke flavouring already on the market in the Member States constitutes a serious risk to human health, this product should be removed from the market without delay.

(14) Since many smoke flavourings are already on the market in the Member States, provision should be made to ensure that the transition to a Community authorisation procedure is smooth and does not disturb the existing smoke flavourings market.

(5) In the light of the large number of flavouring substances in the register and the deadline set by the Regulation by which a list of authorised flavouring substances shall be adopted, the evaluation programme should not waste scientific resources and, therefore, make use of safety assessments already performed by the Committee of Experts on Flavouring Substances of the Council of Europe (CEFS), the Scientific Committee on Food of the European Commission (SCF) and the Joint FAO/WHO Expert Committee on Food Additives (JECFA).
(5) Étant donné le grand nombre de substances figurant dans le répertoire et la date limite fixée par le règlement pour l'adoption d'une liste des substances aromatisantes autorisées, il conviendra de mener le programme d'évaluation en évitant le gaspillage des ressources scientifiques et, par conséquent, d'utiliser les évaluations de la sécurité déjà réalisées par le comité d'experts sur les matières aromatisantes du Conseil de l'Europe (CEMA), le comité scientifique de l'alimentation humaine de la Commission européenne (CSAH) et le comité mixte d'experts FAO/OMS sur les additifs alimentaires (CMEAA).
