1. The fishing opportunities granted under Article 5 of the Fisheries Partnership Agreement shall be as follows:

Rules should be laid down for granting allowances and financial compensation to fishermen and owners of fishing vessels in cases of temporary cessation of fishing activities, if such cessation is the direct consequence of certain conservation measures, excluding the fixing and allocation of fishing opportunities, is provided for in certain Union or national fisheries’ management plans, or results from the non-renewal of Sustainable fisheries partnership agreements or protocols thereto.

3. Support under paragraph 2 for the replacement or modernisation of main or ancillary engines may only be granted in respect of vessels belonging to a fleet segment for which the report on fishing capacity, referred to in Article 22(2) of Regulation (EU) No 1380/2013, has shown a balance with the fishing opportunities available to that segment.

L’aide relevant du titre du paragraphe 2 en faveur du remplacement ou de la modernisation des moteurs principaux ou auxiliaires ne peut être octroyée qu’à des navires appartenant à un segment de la flotte pour lequel le rapport sur la capacité de pêche visé à l’article 22, paragraphe 2, du règlement (UE) no 1380/2013 a fait état d’un équilibre entre les capacités et les possibilités de pêche existant pour ledit segment.

5. The time limit within which the Member States must confirm that they are not fully exhausting the fishing opportunities granted to them under the Protocol, as provided by Article 10(1) of Regulation (EC) No 1006/2008, is set at ten working days from the date on which the Commission communicates this information to them.

4. The time limit within which the Member States must confirm that they are not making full use of the fishing opportunities granted to them, as provided by Article 10(1) of Regulation (EC) No 1006/2008, is set at 10 working days from the date on which the Commission informs them that the fishing opportunities are not being fully utilised.

1. From the date of the provisional application of the Protocol, and for a period of three (3) years, the fishing opportunities granted under Articles 5 and 6 of the Agreement shall be set out to allow the highly-migratory species listed in Annex 1 to the United Nations Convention on the Law of the Sea to be caught, with the exception of those species protected or prohibited by ICCAT or under Gabonese legislation.

1. Where fishing opportunities granted to a third country are deemed to have been exhausted, the Commission shall immediately inform the third country concerned and the competent inspection authorities of the Member States thereof.
1. Lorsque les possibilités de pêche accordées à un pays tiers sont considérées comme épuisées, la Commission en informe immédiatement le pays tiers concerné ainsi que les autorités d'inspection compétentes des États membres.

1. The Commission shall examine applications for fishing authorisations taking into account the fishing opportunities granted to the third country and shall issue fishing authorisations in accordance with the measures adopted by the Council and the provisions contained in the agreement concerned.
1. La Commission examine les demandes d'autorisations de pêche en tenant compte des possibilités de pêche accordées au pays tiers et délivre les autorisations de pêche conformément aux mesures adoptées par le Conseil et aux dispositions contenues dans l'accord concerné.

1. The third country concerned shall, at the date of entry into force of an agreement granting it fishing opportunities in Community waters, submit to the Commission, by electronic transmission, a list of vessels flying its flag and/or registered in it which intend to make use of those fishing opportunities.
