Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). Definition: Symptoms are presented by the patient as if they were due to a physical disorder of a system or organ that is largely or completely under autonomic innervation and control, i.e. the cardiovascular, gastrointestinal, respiratory and urogenital systems. It follows from the third paragraph of Article 19 of the Statute of the Court of Justice, and in particular the term ‘represented’, as well as from the first paragraph of Article 34(1) of the Rules of Procedure of the Civil Service Tribunal, that in order to bring an action before the Tribunal, a party, within the meaning of that article, must use the services of a third person authorised to practise before a court of a Member State or of a State which is a party to the Agreement on the European Economic Area, and that only an application signed by that third person may be validly referred to the Tribunal.

43 (1) If a manufacturer has not completed its first full fiscal year on the day on which it submits its licence application and if a statement signed by the individual responsible for the manufacturer’s financial affairs specifying the commencement date of that fiscal year is provided with the application, the payment of the fee in respect of the application is deferred for a period of one year following the day the application was submitted, together with the payment of any fee that becomes payable in respect of an application for a licence amendment submitted during that period.

27 Having regard to the foregoing, the Court must hold that, by not inviting the appellants to rectify their application before expiry of the period for bringing the action at the time of receipt on 21 and 23 February 2006 of the first application signed by a lawyer who was not authorised to appear before the Community courts, the Court of First Instance did not commit any breach of procedure.

22 For its part, the Commission does not accept that the Court of First Instance was bound to inform the appellants, before expiry of the period laid down by Community law for the bringing of an action for annulment, that the first application signed by two Turkish lawyers did not comply with the formal requirements laid down in Articles 19 and 21 of the Statute of the Court of Justice and contends accordingly that the action had not properly been brought before the Court of First Instance.

20 In essence, the appellants claim that those provisions place on the Community courts the obligation to establish the facts and to act on their own initiative and accordingly, in this case, the Court of First Instance was bound to take action when on 21 and 23 February 2006 it received the first application signed by a lawyer who was not authorised to represent them.

The Court of First Instance held that only the German language version of the application signed by Mr Şahin and lodged at the Registry on 26 April 2006 could be considered to be in proper form.
