[7] In case 241/05 the European Court of Justice ruled that Article 20(1) of the Convention implementing the Schengen Agreement is to be interpreted as meaning that the term ‘first entry’ in that provision refers, besides the very first entry into the territories of the Contracting States to that agreement, to the first entry into those territories taking place after the expiry of a period of six months from that very first entry and also to any other first entry taking place after the expiry of any new period of six months following an earlier date of first entry.

THE COUNCIL OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Economic Community, Having regard to the Act of Accession of Spain and Portugal and in particular Article 396 thereof, Having regard to the proposal from the Commission, Whereas, on account of the accession of Spain and Portugal, it is necessary to adapt Regulation (EEC) No 357/79 (1), as last amended by Regulation (EEC) No 3768/85 (2); Whereas this adaptation must lay down the dates of the first surveys to be conducted by the new Member States so that data allowing the situation in the wine market to be assessed can be obtained as rapidly as possible; Whereas provision should be made for the Community to make a financial contribution towards the expenditure incurred by the new Member States for the first basic survey required by Regulation (EEC) No 357/79; Whereas the results of interim surveys required by the said Regulation have to be available for the new Member States to allow the situation in the wine market to be assessed; Whereas the Kingdom of Spain undertook, in the course of the accession negotiations, to conduct the first basic survey in the year following accession; whereas the Portuguese Republic will conduct a survey of the area under vines in 1987 and the first basic survey in 1989, HAS ADOPTED THIS REGULATION:

The Member States shall provide that cereal seed produced directly from basic seed or from certified seed of the first generation certified in one Member State and harvested in another Member State or in a third country is to be regarded as equivalent to certified seed or to certified seed of the first or second generation if that seed has been harvested in the State which produced either the basic seed or the certified seed of the first generation, if it has undergone field inspection satisfying the conditions laid down in Annex I and if official examination has shown that the conditions laid down in Annex II for certified seed or certified seed of the first or second generation are satisfied.
Les États membres prescrivent que les semences de céréales provenant directement de semences de base certifiées dans un État membre ou de semences certifiées de la première reproduction et récoltées dans un autre État membre ou dans un pays tiers, sont équivalentes aux semences certifiées ou aux semences certifiées de la première ou de la deuxième reproduction, à condition que ces semences aient été récoltées dans l'État producteur soit des semences de base soit des semences certifiées de la première reproduction, et qu'elles aient été soumises sur leur champ de production à une inspection sur pied satisfaisant aux conditions prévues à l'annexe I et s'il a été constaté, lors d'un examen officiel, que les conditions prévues à l'annexe II pour les semences certifiées ou les semences certifiées de la première ou de la deuxième reproduction ont été respectées.
