Is highly concerned by the growing trend of state violence against LGBTI persons in several sub-Saharan countries, especially Uganda, Nigeria, Cameroon and Senegal; firmly condemns attempts to enact ever more repressive laws in countries where homosexuality is already criminalised; calls on fellow parliaments to stop responding to populist and conservative pressure, including from religious leaders, and to protect the rights of all citizens, including LGBTI persons; points out that 76 countries still criminalise homosexuality, including five which provide for the death penalty; regrets again that the Cotonou Agreement was signed with no discussion of discrimination on grounds of sexual orientation as part of its political dialogue, as requested numerous times by this Parliament; reminds the Commission and the Council of Parliament’s firm resolve to include this aspect in the next revision of the Agreement;

– Once again, we had to call on the Seimas to reject the draft amendments to the Code of Administrative Offences, include sexual orientation in the list of protected grounds in the Law on Education, enable minors to freely access information on sexual orientation, and clarify the meaning of the ban in the Law on Advertising, although, at the same time, we acknowledge the firm stand taken on several occasions by President of the Republic of Lithuania, Dalia Grybauskaitė, denouncing draft homophobic legislation as being harmful for Lithuanian citizens and the image of Lithuania.
– (EN) Une fois de plus, nous avons dû demander au Seimas de rejeter les projets d’amendements au code des infractions administratives, de faire figurer le respect de l’orientation sexuelle dans la liste des principes protégés dans la loi sur l’éducation, de permettre aux mineurs d’avoir librement accès aux informations sur l’orientation sexuelle, et de clarifier la signification de l’interdiction formulée dans la loi sur la publicité, même nous reconnaissons en même temps la position ferme adoptée en plusieurs occasions par Dalia Grybauskaitė, présidente de la République de Lituanie, pour dénoncer le caractère préjudiciable du projet de législation homophobe pour les citoyens lituaniens et l’image de la Lituanie.

Without beating this to death or plowing the ground over and over again, I guess I would suggest.I'm sorry, and I apologize to the committee, I haven't had a chance to have this in sort of firm writing, but I simply throw it on the table as at least a possibility of something we could agree upon, some amendment to the effect that rather than have it the way it ends with Madam Redman's motion that we're debating, that the adoption of this motion be reported to the House forthwith, we would remove “forthwith” and put something like “following minor unanimously agreed upon amendments, but no later than one week from today, October 26, 2006”.

Now, however, the Italian authorities are proposing to extend the scheme, once again invoking the grounds which justified its approval in 1994, namely long delays in the payment of moneys owed by contracting authorities, coupled with difficulties experienced by Sicilian firms as a result of the very high cost of bank financing.

This causes inequality of treatment and discrimination with respect of those firms and Member States which follow the notification procedures, as it is clear that an undertaking, in receipt of a non-notified aid, is receiving an illegal advantage, running from the date of the granting of the aid until the Commission's decision on it (In certain cases this financial advantage can be worth several tens of millions of Ecus). In the Boussac judgments of 1990 (Case C-301/87), the Court of Justice did not accept that the Commission had power to find an aid measure incompatible with the common market on the sole ground that it had been granted unlawfully; but it did hold that the Commission could take "measures.to counteract any infringement of Article 93(3) of the Treaty".
