(80)The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Unionin order to: specifythe definitions of "critical functions" and "core business lines", specify the circumstances when an institution is failing or likely to fail specify the circumstances when the asset separation tool should be applied specify the liabilities excluded from the scope of application of the bail-in tool, specify the circumstances when exclusion from the bail-in tool is necessary to ensure the continuation of critical operations and core business lines, specify the criteria for the determination of the minimum amount of eligible liabilities required from institutions for the purposes of the bail in tool, specify the circumstances when, in application of the bail-in tool, existing shares should be cancelled and liabilities should be converted into shares, specify the circumstances when third country resolution proceedings should not be recognised, further specify the conditions under which it should be considered that the target level of the financing arrangements has significantly deviated from the initial level, adopt criteria aimed at adjusting the contributions to the financing arrangements to the risk profile of institutions, define obligations aimed at ensuring the effective payment of the contributions to the financing arrangements and specify the conditions for the mutual borrowing between national financing arrangements.

13. Calls on the Commission to strengthen the ESF’s role in the context of the future architecture of the Structural Funds in order to allow for the better execution of integrated measures; considers that the ESF should be brought under a regulation and a basic strategic framework laying down general provisions on cohesion funding, while maintaining its own rules, and operational and financing arrangements; notes that previous experience has shown that the ESF and ERDF in combination, with the utilisation of up to 10% of ESF funding, have produced successful and sustainable results and that these flexible arrangements must continue to apply; urges the Commission to seek, if needed, increased funding for the Structural Funds, in particular for ESF operational programmes in future to promote employability, with a definition of clear and simple rules that allow more coordinated use of the resources;

Stresses that the fragmentary nature of European financial markets is an obstacle to the sound functioning of risk capital markets and considers it a priority to remedy this in order to give enterprises easier access to sources of finance for enterprises; draws attention to the need to encourage access by enterprises to financial instruments and to develop the availability of financing along the lines of mutual guarantee schemes; calls for the development of innovative financing arrangements in order to respond to the new tangible and intangible investment needs of enterprises, including small and micro-enterprises, particularly in the areas of standards, technologies, the environment and market development; calls for measures to promote the connection between equity capital and funds and for work towards linking funds, enterprises, industry and universities; calls for particular attention to be paid in this regard to instruments targeted at SMEs;

Notes that work on the first extension to the Court's current premises will begin during 2001 and welcomes the Court's commitment to remain within the limit of EUR 25 million (1998 prices) for the total investment cost; agrees that the second extension to the Court's premises, which is planned in order to prepare for the forthcoming enlargement, should follow the first extension without delay, so that additional costs can be avoided; considers that the financing plan proposed by the Court for the first extension (five tranches in the 1999-2003 budgets) and endorsed by the budgetary authority, provides an appropriate model for the financing of the second extension; notes, however, that the recasting of the Financial Regulation could allow the European institutions to improve financing arrangements;
