21. The Council suggests that Article 266 of the draft be worded as follows:"The provisions of Articles 14(2), 46(3)(d), and 185 of the Financial Regulation shall apply to those bodies set up by the Communities which actually receive a grant from the budget and are listed in an annex to the general budget of the European Union for each financial year".

The Council considers that the provisions of the current Financial Regulation relating to the conditions for presenting an amending and/or supplementary budget must be maintained in the new Financial Regulation. It reiterates the desire expressed in its conclusions of 25 January 1999 that a provision be added specifying that an amending budget will be submitted before 31 March of the current financial year and adopted each year with the sole object of entering in the budget for the current year the difference between the outturn actually recorded when the accounts for the completed year are submitted and the estimate of it that was previously made.

Le Conseil considère que les dispositions du règlement financier actuel relatives aux conditions pour présenter un budget rectificatif et/ou supplémentaire doivent être maintenues dans le nouveau règlement financier Il rappelle son souhait, exprimé dans ses conclusions du 25 janvier 1999, de les compléter par une disposition précisant qu'un budget rectificatif soit présenté avant le 31 mars de l'exercice en cours et adopté chaque année dont le seul objet sera d'inscrire dans le budget pour l'exercice en cours la différence entre le solde d'exécution constaté lors de la remise des comptes de l'exercice achevé et l'estimation qui en avait précédemment été faite.

It will be remembered that the other legal texts necessary for Europol's actual operation, i.e. those concerning liaison officers, Europol's Management Board and the Financial Regulation, were already agreed by the Council during previous Presidencies; still to be finalized are the rules on confidentiality as well as the texts on Europol's external relations and the Joint Supervisory Body.
