At the latter date, the Chapters remaining open with the ten countries included in the first wave of accession in 2004 concerned agriculture, financial and budgetary provisions, other issues (including matters such as the creation of a Transition Facility for Institution Building, implementation and management of pre-accession funds in the new Member States, safeguards, contributions of the new Member States to the capital of EIB, etc.), institutions for three candidates (Czech Republic, Hungary and Latvia) and five left-over Chapters (Competition for Hungary and Poland, Transport for the Czech Republic, Taxation and Customs Union for Malta).

3. Obligations resulting from Section II of this Chapter concerning subsidiary undertakings, not themselves subject to this Directive, shall not apply if the EU parent institution or institutions controlled by an EU parent financial holding company or EU parent mixed financial holding company, can demonstrate to the competent authorities that the application of Section II is unlawful under the laws of the third country where the subsidiary is established.

This Chapter is without prejudice to any liability under criminal law which the financial actors referred to in Article 71 may incur as provided for in applicable national law and in the provisions in force concerning the protection of the Union's financial interests and the fight against corruption involving Union officials or officials of Member States.

12. Calls on the Commission to draw up a sound financial chapter concerning the financing of the fisheries agreements which should take into consideration the possible budgetary consequences of any increase of the number of agreements in the near future and the equitable sharing of cost between the Community and the vessel owners in payment for the fishing rights, regardless of the third country with which the agreement has been concluded, bearing in mind that the EU contribution should be considered as a contribution to a commercial agreement and as development aid;
12. invite la Commission à élaborer sur des bases saines un chapitre financier concernant le financement des accords de pêche qui prenne en considération les retombées budgétaires éventuelles de toute augmentation du nombre d'accords dans un avenir proche et le partage équitable des coûts entre la Communauté et les armateurs en contrepartie des droits de pêche, quel que soit le pays tiers avec lequel l'accord a été conclu, en tenant compte du fait que la contribution de l'UE devrait être considérée comme une contribution à un accord commercial et comme une aide au développement;

Calls on the Commission to draw up a sound financial chapter concerning the financing of the fisheries agreements which should take into consideration the possible budgetary consequences of the increase of the number of agreements in the near future and the sharing of cost between the Community and the vessel owners in payment for the fishing rights, regardless of the third country with which the agreement has been concluded, bearing in mind that the EU contribution should be considered as a contribution to a commercial agreement and as development aid;

Takes note of the Commission communication (COM(2003) 274) containing the different legal bases for the activities financed under former Chapter A-30 and for which a legal basis is now needed as a result of the ABB nomenclature; urges the Council to cooperate closely with Parliament to adopt the legal basis before the end of the 2004 budgetary procedure; recalls that Parliament had expressed its preference for a framework regulation in order to avoid the rigidity of specific requirements imposed by various legal bases, depending on the Treaty article concerned; reminds the Commission that the legal aspects should not undermine the principles agreed in Article 107 of the Financial Regulation concerning the implementation of Parliament's priorities; will ensure that none of the European Parliament's political priorities are lost after the change in the system of subsidies; intends to examine all proposals together so as to ensure a coherent legislative framework for all activities under former Chapter A-30 in accordance with the new Financial Regulation;
