(8) In the interest of clarity Commission Decision 94/474/EC of 27 July 1994 concerning certain protection measures relating to bovine spongiform encephalopathy and repealing Decisions 89/469/EEC and 90/200/EEC(17), Commission Decision 94/381/EC of 27 June 1994 concerning certain protection measures with regard to bovine spongiform encephalopathy and the feeding of mammalian derived protein(18), and Decision 2000/418/EC regulating the use of material presenting risks as regards transmissible spongiform encephalopathies and amending Decision 94/474/EC, should be repealed.

(2) Whereas 66 cases of BSE have been notified in Portugal between 1 January 1998 and 14 October 1998; whereas this leads to a BSE incidence rate calculated over the past 12 months of 105,6 cases per million animals over two years of age; whereas two cases have been identified in animals born after implementation of the prohibition on feeding mammalian derived protein to ruminants; whereas the development of the incidence of the disease indicates potential recycling and accumulation of the BSE agent in the Portuguese cattle population;
(2) considérant que l'apparition de soixante-six cas d'ESB au Portugal a été notifiée entre le 1er janvier 1998 et le 14 octobre 1998; qu'il en résulte un taux d'incidence de l'ESB calculé pour la période des douze derniers mois de 105,6 cas par million d'animaux âgés de plus de deux ans; que deux cas ont été identifiés chez des animaux nés après la mise en oeuvre de l'interdiction de l'utilisation de protéines dérivées de mammifères dans l'alimentation des ruminants; que le développement de l'incidence de la maladie laisse supposer un recyclage et une accumulation de l'agent responsable de l'ESB dans la population bovine du Portugal;

Between January 1st and October 27th 1998, 67 cases of BSE have been notified in Portugal, including two cases in animals born after the implementation of the ban on the feeding of mammalian derived proteins to ruminants.

Member States shall prohibit the feeding of protein derived from mammalian tissues to ruminant species.

(11) Whereas, in order to protect animal and human health in the Community, the Commission adopted Decision 94/381/EC of 27 June 1994 concerning certain protection measures with regard to bovine spongiform encephalopathy and the feeding of mammalian derived protein (9), as amended by Decision 95/60/EC (10), which prohibited the feeding of mammalian protein to ruminants throughout the Community, Decision 96/449/EC of 18 July 1996 on the approval of alternative heat treatment systems for processing animal waste with a view to the inactivation of spongiform encephalopathy agents (11), which lays down the best available method for processing animal waste as regards spongiform encephalopathy agents, and Decision 97/735/EC of 21 October 1997 concerning certain protection measures with regard to trade in certain types of mammalian animal waste (12);
(11) considérant qu'afin de protéger la santé humaine et animale dans la Communauté, la Commission a adopté la décision 94/381/CE du 27 juin 1994 concernant certaines mesures de protection relatives à l'encéphalopathie spongiforme bovine et à l'alimentation à base de protéines dérivées de mammifères (9), modifiée par la décision 95/60/CE (10), qui a interdit l'utilisation de protéines de mammifères dans l'alimentation des ruminants dans l'ensemble de la Communauté, la décision 96/449/CE du 18 juillet 1996 relative à l'agrément de systèmes de traitement thermique de remplacement pour la transformation de déchets animaux au regard de l'inactivation des agents de l'encéphalopathie spongiforme (11), qui a établi la meilleure méthode disponible pour la transformation des déchets animaux au regard de l'inactivation des agents de l'encéphalopathie spongiforme, et la décision 97/735/CE du 21 octobre 1997 relative à des mesures de protection en ce qui concerne les échanges de certains types de déchets animaux des mammifères (12);

2. Commission Decision 92/562/EEC on the approval of alternative heat treatment systems for processing high-risk material; 3. Commission Decision 94/382/EC, as last amended by Commission Decision 95/29/EC ,on the approval of alternative heat treatment systems for processing animal waste of ruminant origin, with a view to the inactivation of spongiform encephalopathy agents.In particular this Decision prohibits the use of one rendering system (the continuous vacuum added fat system) and sets new time/temperature parameters for all the other systems approved for the processing of ruminant material according to Decision 92/562/EEC ; 4. Commission Decision 94/381/EC, as last amended by 95/60/EC concerning certain protection measures with regard to bovine spongiform encephalopathy and the feeding of mammalian derived protein.
2. Décision 92/562/CEE de la Commission relative à l'agrément de systèmes de traitement thermique de remplacement pour la transformation de matière à haut risque; 3. Décision 94/382/CE de la Commission, modifiée en dernier lieu par la décision 95/29/CE de la Commission relative à l'agrément de systèmes de traitement thermique de remplacement pour la transformation des déchets de ruminants au regard de l'inactivation des agents de l'encéphalopathie spongiforme bovine. Cette décision interdit entre autres l'utilisation d'un système d'élimination (la méthode continue sous vide avec graisse ajoutée) et fixe de nouveaux paramètres de temps/température pour tous les autres systèmes agréés pour la transformation de matières de ruminants conformément à la décision 92/562/CEE; 4. Décision 94/381/CE de la Commission, modifiée en dernier lieu par la décision 95/60/CE relative à l'encéphalopathie spongiforme bovine et à l'alimentation à base de protéines dérivées de mammifères.

(5) Whereas, in those circumstances and as an emergency measure, it is appropriate to prohibit temporarily the dispatch from Portugal to the other Member States of all bovine animals and of all products obtained from, or incorporating materials derived from, bovine animals which are liable to enter the human food or animal feed chains or are destined for use in cosmetic or medicinal products or medical devices; whereas in order to prevent deflections of trade, the same prohibitions should also apply to exports to third countries; whereas it is necessary to prohibit temporarily the dispatch from Portugal of mammalian meat-and-bone meal and animal feed and fertilisers containing mammalian meat-and-bone meal, which by their nature could enter the animal feed chain;
(5) considérant que, dans ces circonstances et à titre de mesure d'urgence, il convient d'interdire temporairement l'expédition en provenance du Portugal vers les autres États membres de tous les animaux de l'espèce bovine et de tous les produits obtenus à partir de matériels provenant de ces animaux, ou contenant de tels matériels, qui sont susceptibles d'entrer dans la chaîne alimentaire humaine ou animale ou sont destinés à être utilisés dans des produits cosmétiques, des médicaments ou des dispositifs médicaux; qu'afin d'empêcher les distorsions commerciales, les mêmes mesures d'interdiction devraient également s'appliquer aux exportations à destination des pays tiers; qu'il convient d'interdire temporairement l'expédition en provenance du Portugal de farines de viande et d'os de mammifères ainsi que d'aliments pour animaux et d'engrais contenant des farines de viande et d'os de mammifères susceptibles de par leur nature d'entrer dans la chaîne alimentaire animale;

ANNEX I Important measures taken in relation to BSE (a) Community measures (i) export ban on live animals from the UK to the other Member States with the exception of calves under six months under the condition that they are slaughtered before the age of six months (March 1990); (ii) export ban on specified offals (brains, spinal cord, thymus, tonsils, spleen and intestines) from the UK to the other Member States (April 1990); (iii) export of meat from the UK to the other Member States: - from animals under the age of 30 months: no restrictions (first measure 1 March 1990 - latest decision February 1995); - from animals over the age of 30 months coming from a herd with no case of BSE during the last six years: no restrictions (decisions as above); - from animals over the age of 30 months coming from a herd with a case of BSE during the last six years: to be accompanied by a health certificate stating "fresh deboned bovine meat in the form of muscle from which the adherent tissues, including obvious nervous and lymphatic tissues, have been removed" (decisions as above); (iv) ban in the Community on the feeding of mammalian protein to ruminants (June 1994); (v) tightening of rules on rendering of ruminant waste in order to inactivate the BSE agent (June 1994) (b) UK measures: (i) ban on the feeding of ruminant protein to ruminants (July 1988); (ii) ban on specified bovine offals (SBOs) (November 1989); ( i i i ) strengthening of the specified bovine offals ban (August 1995); (iv) ban on the feeding of mammalian protein to all farm animals (March 1996) (c) Member State level: - import ban on meat- and bone-meal from the United Kingdom (d) Community export ban on bovine animals, bovine meat and meat products, etc., and on mammalian-derived meat- and bone-meal from the UK to other Member States and third countries (March 1996).

Decision : Article 1 Pending an overall examination of the situation and Community provisions adopted to protect against bovine spongiform encephalopathy notwithstanding, the United Kingdom shall not export from its territory to the other Member States or third countries : - live bovine animals, their semen and embryos - meat of bovine animals slaughtered in UK - products obtained from bovine animals slaughtered in UK which are liable to enter the animal feed or human food chain, and materials destined for use in medicinal products, cosmetics or pharmaceutical products - mammalian derived meat and bone-meal.
