(3) Where the employees in a portion of the federal public administration that is established as or becomes a part of a corporation or business to which this Part applies are bound by a collective agreement or arbitral award, the corporation or business, as employer of the employees, or any bargaining agent affected by the change in employment, may, during the period beginning on the one hundred and twentieth day and ending on the one hundred and fiftieth day after the date on which the portion of the federal public administration is established as or becomes a part of the corporation or business, apply to the Board for an order determining the matters referred to in subsection (4).

To the extent that it deals with matters referred to in section 12 of the Financial Administration Act, the arbitral award is also binding, on and after that day, on every deputy head responsible for any portion of the federal public administration that employs employees in the bargaining unit.

(6) Where no application for an order is made pursuant to subsection (3) within the period specified in that subsection, the corporation or business, as employer of the employees, or any bargaining agent bound by a collective agreement or arbitral award that, by subsection (1), is continued in force, may, during the period commencing on the one hundred and fifty-first day and ending on the two hundred and tenth day after the date the portion of the federal public administration is established as or becomes a part of the corporation or business, apply to the Board for an order granting leave to serve on the other party a notice to bargain collectively.

The bill provides that federal businesses carrying on activities in Quebec will be subject to certain requirements, including the following: using French in their written communications with the Government of Quebec and with corporations established in Quebec; giving their employees the right to carry on their activities in French; drawing up communications to their employees in French; preparing offers of employment in French and publishing them in a daily newspaper at the same time, and with at least equal prominence as any offers published in a daily newspaper in a language other than French; preparing collective agreements and their schedules in French; and finally, ensuring that arbitration awards made following arbitration of a grievance or dispute regarding the negotiation, renewal or review of a collective agreement shall, at the request of one of the parties, be translated into English or French, as the case may be, at the parties' expense.
Le projet de loi fera en sorte que les entreprises fédérales qui exercent leurs activités dans la province de Québec suivent certaines exigences. En voici quelques-unes: les entreprises devront utiliser le français dans leurs communications écrites avec le gouvernement du Québec et avec les personnes morales établies au Québec; elles donneront à leurs employés le droit d'exercer leurs activités en français; elle rédigeront en français les communications qu'elles adressent à leurs employés; elles rédigeront en français les offres d'emploi et les publieront dans un quotidien simultanément avec les offres d'emploi publiées dans une autre langue, et ce, dans une présentation au moins équivalente; elles rédigeront en français les conventions collectives et leurs annexes; enfin, toute sentence arbitrale à la suite de l'arbitrage d'un grief ou d'un différend relatif à la négociation, au renouvellement ou à la révision d'une convention collective sera, à la demande d'une partie, traduite en français ou en anglais, selon le cas, et ce, aux frais des parties.
