In its judgment of 22 November 2001 in Ferring, [1] the Court inclines to the view that compensation which does not exceed what is necessary to perform SGEIs does not confer any advantages on the recipient undertakings and does not, therefore, constitute state aid within the meaning of the EC Treaty.
